<br />: i <br />I'i <br />,I <br /> <br />.~ <br /> <br />RESOLUTION No. 01-071 <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF SP 01-11. <br /> <br />WHEREAS, an application for a special use permit and site plan has been made by Roseville Properties <br />to construct a new 12,835 square foot building to house Voyd Trailer Company at 525 1'1 Street SW.; <br />and, <br /> <br />WHEREAS, the subject property is zoned 1-2, Heavy Industrial. Section 6~140 of the Zoning Ordinance <br />states that the City Council may permit any use in the 1-2 industrial district (except residential uses) by <br />means of a Special Use Permit if the use meets the standards of Section 8-130 (special use criteria); <br />and, <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />I. An application for a special use permit was filed with the City of New Brighton on August <br />3,2001. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on August 2, 200 I, and all persons present at the hearing were given an opportunity to be <br />heard. The Planning Commission unanimously recommended approval of the request <br />subject to conditions. <br />3. The City Council considered the proposal at its August 28th 2001 meeting; and <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect <br />to SP 01-11: <br /> <br />I. Tlhe subject site is zoned 1-2, Light Industrial. <br />2. Roseville Properties plans to lease the site to Voyd Trailer Company to be used as an office, <br />and as a truck terminal and storage facility. <br />3. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use shall <br />be recommended by the Planning Commission unless such shall find: <br /> <br />a. That the establishment, maintenance, or operations ofthe special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general <br />public. <br /> <br />b. That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br /> <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement ofthe surrounding property for uses permitted in <br />the district. <br /> <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have <br />been or are being provided. <br /> <br />e.
