Buying excess liability coverage under the "waiver" option does not protect the City any better. <br />The benefit is the injured party. If the City waives the statutory limit, an individual claimant <br />could recover up to $1,200,000 in damages on a claim. The individual would still have to prove <br />to the court or jury that he/she really has that amount of damages. Also, the statutory limit of <br />$1,200,000 per occurrence would still apply; that would limit the individual's recovery to a <br />lesser amount if there were multiple claimants. <br />Costs and Funding: The expenditures for insurance premiums are charged in the Risk <br />Management Internal Service Fund. The Risk Management Fund in turn charges the <br />various operations of the City for their appropriate share. The General Fund pays the <br />majority of the Risk Management charges.
