• <br />RESOLUTION NO. 09-085 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION ORDERING PROJECT AND AUTHORIZING PREPARATION OF <br />PLANS AND SPECIFICATIONS FOR PROJECT 10-3, SILVER LANE <br />RECONSTRUCTION. <br />WHEREAS, pursuant to Resolution 09-069 of the. City Council of the City of New <br />:on, adopted November 9, 2009, a date was set for a Council Hearing on proposed <br />vement Project 10-3, Silver Lane Reconstruction; and, <br />WHEREAS, ten days published notice of the hearing through two weekly <br />ications of the required notice was given and the hearing was held thereon the 8th <br />of December, 2009, at which time all persons desiring to be heard were given an <br />eunity to be heard thereon. <br />NOW, THEREFORE LET IT BE RESOLVED, by the City Council of the City of <br />Brighton, Minnesota: <br />1. Such improvement is hereby ordered as proposed. <br />2. St. Anthony's City Engineer, WSB and Associates, Inc., (WSB) is hereby <br />designated as the engineer for this improvement project and is hereby <br />authorized to proceed with the preparation of the plans and specifications. Said <br />plans and specifications must be approved by the City of New Brighton prior to <br />advertisement of bids. <br />3. Subject to the approval of the City Attorney, enter into a cooperative agreement for the <br />administration and division of costs associated with silver lane reconstruction in the <br />cities of New Brighton and Saint Anthony. The agreement will outline the costs for <br />design services for the engineer. WSB's costs shall be limited to 9 percent of the <br />contract costs, up to a maximum $60,000 total, exclusive of geotechnical and <br />construction material testing costs. <br />this 8th day of December, 2009.. <br />Vianiel A.
