January 26, 2010 Page 3 of 5 <br />Motion by Councilmember Phillips, seconded by Councilmember Samuelson to adopt <br />the attached Resolution approving the Special Use Permit and authorize the City <br />Wanager and Mayor to enter into a Tower Lease Agreement between the City of New <br />righton and Clear Wireless LLC, as approved by the City Attorney, for property <br />located at 660 51h ST SW. <br />5 Ayes, 0 Nays -Motion Carried <br />2. Consideration of a Special Use Permit and Lease Agreement to allow replacement of an <br />existing 70' light pole with a 100' monopole to include installation of six antennas at <br />Freedom Park, 2121 14th Street NW. Report No.10-029. Resolution No.10-013. <br />City Planner Janice Cnmdlach explained the Special Use Permit would allow for an existing 70' <br />light pole to be replaced with a 100' light pole that would support telecommunications <br />equipment. The equipment includes a utility cabinet roughly the size of a small <br />refrigerator. The expected installation would be the summer of 2010. Staff has <br />informed the applicant that these types of requests in parks have not been approved <br />previously (exception being Creekview Park). One resident attended a neighborhood <br />meeting, and was not opposed to the request. Lastly, with the additional 30' of height <br />added to the pole, there may be a possibility for future co -location with another <br />telecommunications provider. It should be noted, Clearwire will retain ownership of the pole <br />and the ability to generate lease revenue from future co -locators. The City's ability to <br />10erate revenue through co -location is by leasing ground space. The Planning <br />001mmission voted unanimously to recommended approval. The lease agreement with <br />Clearwire is for a 20 -year period with an initial 5 -year term and three 5 -year renewal <br />periods. The rent payment is $17,475 <br />commencing upon the date Clearwire <br />occurs first.
