COMMISSION PROCEEDINGS <br />Regular Meeting — November 17, 2009 at 7:00 p.m. <br />Present: Commissioners James Alvey, Larry Baker, Steve Danger, Bruce Howard, Verne McPherson, <br />Norm Schiferl, and Paul Zisla. <br />Absent: <br />Also Present: David Phillips, Council Member, and Janice Gundlach, City Planner. <br />Agenda Review: Agenda was approved. <br />Minutes: Minutes for October 20, 2009 were presented and approved. <br />Council Action: Council Member Phillips announced Dave Jacobson was elected as the City's new <br />Mayor and Char Samuelson was elected as a new Council Member, with Gina Bauman being the <br />returning member. The new mayor and council members will be swom in on January 4, 2010. He also <br />reported a Public Hearing regarding the tax levy will be held on December I" at 6:30 pm, and the final <br />adoption of the budget is scheduled for December 8`h. He also welcomed Verne McPherson to the <br />Planning Commission. <br />Oublic Hearing: SP2009-010 Special Use Permit to Permit Replacement of a 70' Light Pole at <br />Freedom Park with a 100' Light Pole to Include 3 Panel Antennas, 3 Microwave Dishes, and <br />Ground Equipment at Freedom Park, 2121 14`h ST NW <br />The applicant works for Buell Consulting and is acting on behalf of Clearwire Communications. The <br />Special Use Permit would allow for an existing 70' light pole to be replaced with a 100' light pole that <br />would support telecommunications equipment. The existing lights would be remounted at 70' with three <br />panel antennas and three microwave dishes mounted at the top of the 100' pole. Additionally, the <br />applicant's request includes a 10' x 10' ground space to support the equipment necessary to control the <br />antennas. The equipment includes a utility cabinet roughly the size of a small refrigerator. The proposed <br />location of the proposed light pole within Freedom Park is at the southwest corner of the hockey rink or <br />southeast corner of the ball field. The expected installation would be the summer of 2010. <br />Alvey inquired if the City would own the pole after the project is completed. Gundlach replied that the <br />Director of Public Works conducts all of the lease negotiations' and the Council has approved other <br />applications that have included scenarios where the City owns the pole and the applicant owns the pole. <br />Alvey asked why the applicant had proposed using a privacy fence around the utility cabinet. Gundlach <br />replied that the applicant proposed the fence to help screen the cabinet; however the Park and Recreation <br />Commission felt that the fence called too much attention to the area and would possibly invite graffiti. <br />Schiferl asked staff what color the utility cabinet would be. Rob Vieira, the applicant, replied that <br />cabinet is typically cream in color, but is willing to paint the cabinet any color. He added that the fence <br />was proposed to help prevent tampering with the cabinet, but with the Park and Recreation's response it <br />,was <br />removed and the new recommendation would be to add arborvitae to help conceal the cabinet. <br />
