That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />Not applicable as the site is nearly 100% developed. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or <br />are being provided. <br />This criterion is met as adequate utilities, access roads, and drainage is being <br />provided. <br />e. That the special use shall, in all other respects, conform to the applicable regulations <br />of the district in which it located. <br />As noted in the Site Plan Analysis above, this criterion is met. <br />In conclusion, staff finds all special use standards are met subject to conditions. <br />STAFF RECOMMENDATION <br />Staff recommends approval of the Site Plan and Special Use Permit subject to the following <br />conditions: <br />1. Incorporation of the recommendations made by the City's landscape consultant, noted in <br />his memo dated 3/9/2010. The revised plan shall be submitted to the City Planner for <br />review in conjunction with the building permit submittal. <br />2. Incorporation of all recommendations made in the Interoffice Memos from the City <br />Engineer, Public Safety and Parks & Recreation staff, which includes the following: <br />a. The right -out only curb cut is reconfigured to prevent left turns. <br />b. If the landowner is willing, a 7' trail/sidewalk easement adjacent to the western, <br />north/south property boundary should be dedicated. <br />c. A crosswalk is painted across the drive -aisle from the entrance at the northwest corner <br />of the restaurant to the parking located along the northern property boundary. <br />3. Drive-thru hours may begin at 5 AM. <br />4. Not all wall signs depicted on Sheets A2.0 and A2.1 will be permitted but rather wall signs <br />shall comply with Zoning Code Section 9-080.
