as fast food establishments. <br />Staff does not recommend and additional conditions as there are no adjacent or nearby <br />uses that will be negatively impacted by the drive-thru. <br />H. The following hours of operation shall be imposed: <br />1. For properties abutting R-1, R-lA and R-2: Sunday — Thursday 7:00 AM — 9:00 <br />PM and Friday — Saturday 7:00 AM — 10:00 PM. <br />2. For properties abutting all other zoning districts: Sunday — Thursday 6:00 AM — <br />11:00 PM and Friday — Saturday 6:00 AM —12:00 PM. <br />The City Council may impose different hours of operation based upon specific <br />characteristics of adjacent and nearby uses. <br />The applicant's narrative requests expanded drive-thru hours. Staff finds this request <br />acceptable as the drive-thru is located in a manner that will not cause any negative <br />impacts to adjacent or nearby uses. This is noted in the conditions of approval. <br />1. Any menu/ordering signage interior to the site with an intercom shall not be audible <br />from residentially zoned property and if illuminated shall be directed away from <br />residentially zoned property. <br />This criterion is not applicable as there are no residential uses nearby. <br />J. Fencing and or landscaping may be required to shield head -light illumination from <br />adjacent and nearby areas. <br />Staff would not recommend any fencing or landscaping to specifically shield head -light <br />illumination as the only impacted property would be to the north, which is used as an <br />industrial building. Additionally, this site sits lower in elevation suggesting head lights <br />will not be problematic. <br />Additionally, the general health, safety and welfare standards of Zoning Code Section 8-130 <br />must be considered, as is required for all Special Use Permits. The Planning Commission shall <br />determine the following findings are met. Staff has provided the following responses in italics: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of the general <br />public. <br />Stafffnds this criterion is met as the use already exists and has not been detrimental <br />to the public health, safety, morals, or comfort of the general public. Rebuilding the <br />site will only improve the area. <br />b. That the special use will not be injurious to the use and enjoyment of other property <br />in the immediate vicinity for the purposes already permitted, nor substantially <br />diminish and impair property values within the neighborhood. <br />0 <br />
