SPECIAL USE PERMIT ANALYSIS <br />Zoning Code Section 11-020 (10) requires a Special Use Permit for construction of a new drive- <br />thru facility within the City. The following standards are required. Staff has provided responses <br />in italics: <br />A. The drive-thru facility does not negatively impact traffic on public rights-of-way. <br />Staff finds this criterion is met. A separate drive-thru lane is proposed providing <br />adequate area for stacking so as not to interfere with the public right-of-way. <br />B. A stacking lane shall be provided with a minimum of four spaces per lane in addition <br />to the number of required parking spaces. <br />Staff finds this criterion is met. A stacking lane well in excess of 4 spaces is provided for <br />both lanes. <br />C. The stacking lane shall be a minimum of twelve feet wide. <br />Staff finds this criterion is met. The westerly stacking lane is marked at 12' meeting this <br />standard. The easterly lane is marked at 10', however the driveway directly adjacent is <br />26' leaving a functional 12' lane for the easterly drive-thru. <br />D. The vehicle stacking lane shall not extend beyond the street right-of-way line. <br />Staff finds this criterion is met. The stacking lane is separate from the parking lot drive - <br />aisles, leaving approximately 300' for vehicle stacking. <br />E. The vehicle stacking lane shall be delineated so that vehicles waiting in line will not <br />unreasonably interfere with the primary driving, entrance, exit, and parking facilities on <br />site. Employee -only designated parking may be considered in an effort to comply with <br />this condition. <br />Staff finds this criterion is met as the stacking lane is separate from the primary driving, <br />entrance, exit, and parking facilities on site. <br />F. Any pedestrian walkway that is adjacent to or crosses the stacking lane must be <br />marked and clearly indicated with signage or painted crosswalk. <br />Staff recommends an additional condition of approval to ensure this criterion is met. Of <br />concern is the northwest corner entrance of the restaurant and the parking stalls along <br />the northerly lot line. While a "watch for pedestrians" sign is proposed it is unclear if <br />vehicles waiting at the drive-thru window would be aware there is a restaurant entrance <br />30' in front on the drive-thru window. Thus, to ensure pedestrian safety staff <br />recommends a crosswalk is painted from the northwesterly restaurant entrance north <br />across the drive -aisle to the parking along the northerly lot line. <br />G. The drive-thru use may be limited so as not to unreasonably interfere with adjacent <br />and nearby uses. Limits of use may include, but is not limited to, prohibition of certain <br />uses that may be inappropriate due to their demand on parking and stacking needs, such <br />
