RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A SPECIAL USE <br />PERMIT. <br />WHEREAS, an application has been made by Abdallah Kadid to permit operation of an automotive <br />services use that includes detailing, minor repair, brokerage, and sales at the existing building <br />located at 833 3`d ST SW, Suite #1, and <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on January 22, 2010. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on February 16, 2010 and all present were given a chance to freely speak at the hearing. <br />3. Per the applicant's request, the Planning Commission tabled action on the Special Use Permit <br />request on February 16, 2010. <br />4. The applicant notified staff on February 26, 2010 of his intention to move locations to 833 3`d <br />ST SW from 855 3`d ST SW. <br />5. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on March 16, 2010 and all parties present were given a change to freely speak at the hearing. <br />6. The Planning Commission voted to recommend approval subject to conditions. <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br />Special Use Permit (SP20 10-00 1): <br />1. The property is zoned I-1, Light Industrial. <br />2. The property is guided in the Comprehensive Plan for Light Industrial. <br />3. The property is described as follows: <br />Ex E 640 ft. The S 190 ft Mol of N %2 of SE 1/4 of NW 1/4 of Section 32 Township 30 Range <br />23 (that certain portion of the building addressed 833 SW Third Street Suite #1, consisting of <br />approximately 3,000 square feet, as measured from the outside walls of the premises to the <br />center of the partition wall). <br />4. The applicant has proposed to operate an automotive services and sales business at the <br />property. <br />5. Zoning Code Sections 5-240 (6) & (7) and 6-050 (2) indicate a Special Use Permit is <br />required for an automotive services and sales use. <br />6. The Planning Commission reviewed the proposal in accordance with the following Special <br />Use Permit conditions of Zoning Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />b.
