- Report Number 10-088 <br />Agenda Section VI -6 <br />Date April 13, 2010 <br />UW city that works for you <br />REQUEST FOR COUNCIL CONSIDERATION <br />ITEM DESCRIPTION: CONSIDERATION OF SOUTH WATER TOWER GROUND SPACE <br />LEASE AGREEMENT WITH TTM. <br />DEPARTMENT HEAD'S APPROVAL: &oiv) <br />CITY MANAGER'S APPROVAL: � <br />No comments to sunDlement_this renortl - Comments attached <br />Recommendation: Subject to the Oppival of the City Attorney, authorize the City Manager <br />and the Mayor to enter into :a Coikfiunications Site Lease Agreement (ground space only) <br />between the City of New Brighton and TTM Operating Corporation, Inc. for property located at <br />660 5`n Street SW located on the South Water Tower site. <br />Legislative History: On November 24, 2009, the City of New Brighton entered into similar <br />lease with TTM at the Forestdale Tower site. It should be noted this lease is ground space only, <br />no antennas or towers are proposed to be constructed as a part of this agreement. Therefore, a <br />Special Use Permit is not required for this site. <br />Financial Impact: The lease agreement with TTM is for a 20 -year period with an initial 5 -year <br />term and three 5 -year renewal periods. The rent payment for 2010 is $400 per month, <br />commencing May 1, 2010. Starting January 1, 2011, the rent will be annually adjusted upward <br />by the Consumer Price Index or 4%, whichever is greater. Along with rent, TTM will pay the <br />City a $1,000 fee for review of the site plan and negotiation of this agreement. <br />Explanation: Verizon has contracted with TTM to upgrade their wireless network to 4G <br />technology known as "LTE" (Long Term Evolution). To address that need, TTM provides <br />protected end to end, fully managed backhaul solutions to wireless operators by use of a private <br />fiber optic network. TTM builds and operates regional backhaul networks from the cell sites <br />back to the wireless carrier's switches. TTM eliminates the need for wireless carriers to commit <br />capital to build out their own expensive backhaul infrastructure. <br />Under the terms of the lease agreement, TTM would lease a portion of the South Water Tower <br />site for 32 square feet of ground space for an equipment pad, right of way for ingress, egress and <br />utilities. <br />GranfM., Wy s,'P.E. <br />Director of Public Works <br />Attachment: Communications Site Lease Agreement <br />
