Section 4-040 (3) (B) also requires compliance with the following special use standards of <br />Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of the general <br />public. <br />Staff finds this criterion to be met. The proposed entryway will in no way cause <br />detriment or danger to the general public as the site will continue to be used in a <br />residential nature. <br />b. That the special use will not be injurious to the use and enjoyment of other property <br />in the immediate vicinity for the purposes already permitted, nor substantially <br />diminish and impair property values within the neighborhood. <br />Stafffinds this criterion to be met. The proposed entryway will not be injurious to the <br />use or enjoyment of other property as all other property is of a residential nature as <br />is the proposed entryway. The proposed improvement to this property should impact <br />property levels in the neighborhood positively: <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />Staff finds this criterion to be met. This residential neighborhood is fully developed <br />and the proposed addition is allowable under current R-1 zoning standards. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or <br />are being provided. <br />Staff finds this criterion to be met. The property is currently served with adequate <br />utilities, maintains a legal driveway, and the proposed addition will be one step <br />above grade providing for positive drainage away from the home. <br />e. That the special use shall, in all other respects, conform to the applicable regulations <br />of the district in which it located. <br />Staff finds this criterion to be met. The proposed addition will comply with all other <br />residential standards relating to setbacks, building height, lot coverage, and - <br />impervious surface standards. <br />Based on the above responses, staff finds the special use standards of Section 8-130 to be <br />met. <br />
