RESOLUTION No. <br />10-013 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVAL OF A SPECIAL USE PERMIT. <br />✓HER s, an application has been made by Rob Viera on behalf of Clearwire Communications to <br />allow placement of a 70' light pole with a 100' light pole, including installation of three panel <br />anten s, three microwave dishes, and a ground utility cabinet at Freedom Park, 2121 14th Street <br />NW, d <br />'HERs, the procedural history of the application is as follows: <br />1. A application for a Special Use Permit was received on October 30, 2009. <br />2. T Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on qovember 17, 2009 and all present were given a chance to freely speak at the hearing. <br />3. Tft applicant held a neighborhood meeting at Freedom Park on Thursday, November 12, <br />2019. <br />4. T Planning Commission recommended the City Council approve the request on November <br />17 009. <br />5. Tapplicant was notified in writing on December 11, 2009 that the City would be <br />ej�c <br />ising their right to take an additional 60 days to review the request. <br />6. TCity Council considered the request on January 26, 2010. <br />✓HERE , the Planning Commission and City Council makes the following Findings of Fact with <br />respec o the Special Use Permit (SP2009-010): <br />1. Th. property is zoned R-1, Single Family Residential. <br />2. T property is guided in the Comprehensive Plan for Park. <br />3. Th applicant has proposed to construct at 100' pole, to replace the existing 70' pole, <br />in 1 ding installation of three panel antennas, three microwave dishes, an at grade utility <br />ca net, and remounted of the ball field lights at 70' at Freedom Park, 2121 14`" Street NW. <br />4. Th proposal also includes a 10' x 20' lease area to support the ground equipment, which is <br />roul My the size of a small refrigerator. <br />5. See ion 4-600 (2 & 4) provides for several performance related standards that all wireless <br />telecommunication facilities must meet. <br />6. Th Planning Commission and City Council determined those criteria of Section 4-600 (2 & <br />4) e met. <br />7. Th Planning Commission and City Council reviewed the proposal in accordance with the <br />fol wing additional Special Use Permit standards of Zoning Code Section 8-130: <br />a. hat the establishment, maintenance, or operations of the special use will not be <br />etrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />b. Fhat the special use will not be injurious to the use and enjoyment of other property in <br />he immediate vicinity for the purposes already permitted, nor substantially diminish and <br />mpair property values within the neighborhood. <br />
