That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />10. a Planning Commission and City Council found the Special Use Permit criteria of Section <br />130 are met due to the following: <br />The proposed pole would be a multi-purpose pole in that the City's ball field lights will <br />be mounted on the pole with the telecommunications antenna. <br />b. Adequate room exists between the ball field lights and Clearwire's antenna should <br />another telecommunications provider wish to locate at Freedom Park. <br />The antennas will be painted to match the pole and thus blend well with the surroundings. <br />Ground equipment will maintain adequate setback and security. <br />A neighborhood meeting and a public hearing where held where no residents expressed a <br />concern regarding the proposal. <br />OW HEREFORE BE IT RESOLVED, that based upon the above Findings of Fact the application <br />R r a Special Use Permit (SP2009-010) is hereby approved, subject to the following conditions: <br />1. I he Special Use Permit shall be valid for 12 months from the date of Council approval. <br />2. 1 he applicant enters into a lease agreement with the City, to be approved by the City <br />ouncil. <br />3. 1 he applicant agrees to paint the ground cabinet brown and not implement the fencing or <br />ndscaping, as shown on the submitted plans. <br />4. 1 he applicant agrees to engineer the pole to be extendable by an additional 15' to support <br />lure co -location. <br />5. ihould another telecommunications provider wish to locate on this pole, a Special Use <br />ermit must be submitted for review along with a lease agreement with the City Council. <br />dop d this 26h day of January, 2010. <br />Dave JWobsen, Mayor <br />A .4T - C_ <br />Daniel E%.
