Resolution No. 10-026. <br />Motion by Councilmember Burg, seconded by Councilmember Samuelson to approve the <br />Consent Agenda as presented. <br />5 Ayes, 0 Nays -Motion Carried <br />Councilmember Phillips commented on Item No. 9; (Consideration ofresolutionamending the 2010 <br />Genual Fund Budget.) and thanked City Manager Lotter, staff and council for their diligence in working with <br />the budget. <br />Public Hearine <br />1. Public hnprovement Hearing to Consider Project 10-1, 2010 Sheet Reconstruction <br />ReportNo. 10-096, Resolution No. 10-027. <br />' Director ofPublic Works, Grant Wyffels introduced the 2010 Street Reconstruction project. Aninformational <br />meeting was held February 11, 2010,18 residents representing 20 properties were in attendance. Information <br />specific to each street was presented, photos were displayed Club & gutter will not be replaced, unless deemed <br />hazardous. The pond at Meadow Wood park is scheduled to be removed and replaced with a NURP pond with <br />a dry infiltration pond Additionally some ofthe willow trees, along with the gazebo and aportion ofthe <br />bituminous path will be removed The gazebo could berelocated to a better location within the park <br />Total project cost was reported as $736,000; of that 25% is assessed to the property owners; $1,320 per single <br />flmilyresidence, and $660 Per multi f rrulyresidence. Staffrecommends council hold a Public Hearing and <br />adopt the resolution ordering the project. <br />Mayor Jacobsen opened the Public Hearing at 7:03 pm. <br />Ron Olson, 2026 - 28' Ave NW reported Brightondale Senior Housing should be held responsible to clean up <br />their holding pond, and was concerned they be assessed for theirportion Mr. Olson reminded Council ofthe <br />efforts taken by City StaffaW City Council in the past to implement a landscape plan for Brightondale. Mr. <br />Olson noted there were no photos of28 h Avenue, Director Wyffels explained that was an oversight, and <br />apologized Councilmember Bauman questioned ifthe City can require Brightondale to clean out the brush in <br />the pond, to reduce the runoff, as it maybe counterproductive. City Attorney LeFevee explained that although <br />the property owner may be negligent, they maynot be obligated to maintain the drainage pond, only ifthere is a <br />private obligation to maintain that. CouncilmemberPhillips suggested pond maintenance be addressed with <br />'Brightondale.
