April 27, 20 <br />PRD's and PUD's. The code amendment establishes a Commencement Date of 6 months and a <br />Compliance Date of 18 months. The Commencement Date would be the date a building permit <br />46obtained. The Compliance Date would be the date all project improvements are complete. <br />e ordinance allows the City Council to extend these dates if necessary. Lastly, implementation <br />of expiration deadlines is common practice with virtually every land use approval, with 6 months <br />being the current standard for most requests. The Planning Commission considered the request <br />and held a public hearing on April 20, 2010. No public testimony was given. The Commission <br />requested it be clarified by the City Attorney that this ordinance will apply to the Brightondale <br />PRD approval of May 26, 2009. Staff has clarified that it will apply to this project and intends to <br />inform Brightondale ownership, in writing, of the impacts this ordinance will have on them <br />(assuming it is adopted). Councilmember Burg questioned the procedure related to the <br />requirements by the state and the requirements related to FEMA. Ms. Gundlach reported <br />Minnesota State Law will allow you to rebuild a non -conforming structure; unless it is a flood <br />plain impacted structure that does not meet FEMA requirements, you cannot rebuild it. <br />Motion by Councilmember Phillips, seconded by Councilmember Burg to adopt the <br />attached Ordinance amending Zoning Code Sections 7-100(2), 7-100(7), and 7-250. <br />5 Ayes, 0 Nays -Motion Carried <br />4. Consideration of Request to Install Flashing Crosswalk Lights at Highview Middle School. <br />Report No. 10- 114. <br />DirectorofPublic Works Grant Wyffels explained This item was presented at the April 13, 2010 City <br />Council Meeting and tabled for more discussion. The Council requested additional information <br />on crosswalk signage (color, location, etc.), and type of crosswalk markings (color, design <br />layout, etc.) Crosswalk lights cost approximately $10,000 and are eligible for Municipal State <br />Aid (MSA) funding if the crosswalk is located on a MSA route. In this case, 7th Street NW is an <br />MSA street. Based on actual unit bid prices from City Project 10-9, 7th Street Mill and Overlay, <br />the cost for these lights are $9;500. The cost for the installation of additional and replacement <br />crosswalk signage to upgrade the signage to high visibility fluorescent yellow -green diamond <br />grade is approximately $4,500. In school zones, Mn/DOT recommends the installation of <br />advance warning signs and crosswalk signage on both sides of the crosswalk. In addition, <br />Mn/DOT recommends the color of signage be consistent throughout the entire school zone. Staff <br />has reviewed the signage and recommends the installation of high visibility fluorescent yellow - <br />green diamond grade be installed throughout both the Highview Middle and Bel Air Elementary <br />School Areas. Staff contacted Ramsey County Public Works for more information on <br />crosswalks. In general, Ramsey County does not think crosswalk markings varying in color, <br />design, or layout from the standard '`zebra" type crosswalk marking pattern at uncontrolled mid - <br />block intersections improves safety. Color or other non-standard types of crosswalks may help <br />define the space of the crosswalk reserved for pedestrian to walk. The plan currently calls for a <br />"zebra" type crosswalk marking pattern at each crosswalk. This is consistent with Mn/DOT <br />ldance on crosswalk marking. Staff is comfortable with the plan and type of crosswalk <br />Wpgking proposed. Councilmember Phillips reported he was in favor of the proposed signage <br />rades and ordering a feasibility report for the installation of sidewalks. Councilmember <br />Phillips also stated he felt comfortable delaying the flashing crosswalk, but would favor the <br />Page 5 of 7 <br />4.
