City of New Brighton requests approval of a Zoning Code amendment amending <br />Chapter 10 to reflect the Federal Emergency Management Agency's updated <br />floodplain regulations and revised maps and approval of an ordinance summary <br />for publication. Report No. 10-112. <br />City Planner Janice Gundlach explained the proposed Floodplain Management Ordinance (Chapter 10 ofthe <br />Zoning Code) includes enactment ofrevised Food Insurance Rate Maps effective June 4, 2010. These updates <br />are in response to amandate by the Federal Emergency Management Agency (FEMA) and are necessary to <br />ensure New Brighton residents can continue to participate in the National Flood Insurance Program. If the <br />amended ordinance is not adopted by June 4, 2010, New Brighton residents with floodplain impacts will not be <br />able to obtain flood insurance. New Brighton historically has adopted the model ordinance required by FEMA, <br />and has not included any additional more -restrictive regulations. A summarized list of the ordinance revisions <br />was provided. Because a limited number of structures exist within the floodplain in New Brighton, use ofthe <br />regulations has been extremely limited Because the actual ordinance is 21 pages staff would recommend that a <br />swrimarybe published in place of the entire ordinance to save on publishing costs <br />Councilmember Phillips suggested residents living in the following areas: 17th Avenue NW, Pike Lake Circle, <br />Patten Road, Emerald Drive, and 13r' Ave NW take a close look at the maps available at City Hall. . <br />City Planner Gundlach explained elevation is the detemining factor in flood plain boundaries, and any proposed <br />additions in a flood plain be looked at closely. <br />Motion by Councilmember Burg seconded by Councilmember Phillips to adopt the attached ordinance <br />.Tiending Chapter 10 of the Zoning Code to reflect updated floodplain management regulations, <br />Wuding enactment of revised flood insurance rate maps effective June 4, 2010, consistent with FEMA <br />requirements - <br />5 Ayes, 0 Nays -Motion Carried <br />Motion by Councilmember Burg seconded by Councilmember Phillips to approve the ordinance <br />summary to be published in the City's official newspaper in lieu of publishing the entire ordinance. <br />5 Ayes, 0 Nays -Motion Carried <br />3. City of New Brighton requests approval of a Zoning Code amendment amending <br />Chapter 7 to clarify expiration dates for Planned Unit Development and Planned <br />Residential Development approvals that are not acted on within a specified period <br />oftime. ReportNo.10-113. <br />City Planner Janice Gundlach stated the proposed Zoning Code amendment to Chapter 7 would <br />establish expiration dates for Planned Residential Developments (PRD) and Planned Unit <br />velopments (PUD). The current language is either completely silent on expiration dates (PUD <br />andards) or indicates that the City Council must establish expiration dates at the time of <br />approval (PRD standards).
