Approved <br />Staff recommends approval of the Nonconforming Use Permit, subject to the following; <br />• Following removal of the detached garage, the following site improvements are made: <br />• Pavement is matched and resurfaced to ensure positive drainage. <br />• Parking area is reconstructed to meet a 15' front yard setback. <br />• The parking area is re -striped to provide for 75 surface stalls. <br />• If future curbing AND sidewalk improvements are made to the parking area between the <br />buildings and 35W, the parking lot is reconstructed to meet a 5' setback from the rear lot <br />line. <br />• The southerly located detached garage is repaired in that the exterior siding and doors are <br />cleaned and repainted as needed. <br />Commissioner Schiferl asked what it would take for the applicant to meet both the covered and <br />uncovered parking requirements. City Planner Gundlach responded either underground parking <br />or a parking ramp; neither of which would be practical. <br />Chair Howard opened the Public Hearing <br />Bernice Daas asked why surveyors were working so far away from the property. City Planner <br />Gundlach explained the survey process often begins far away from the subject property, and work <br />their way closer for a variety of reasons. <br />Terry Sandquist, representing Bethel University expressed his appreciation to City Planner <br />Gundlach for her assistance in the process. <br />Motion by Commissioner Schiferl, seconded by Commissioner Nichols-Matkaiti to close the Public <br />Hearing. <br />Approved 6-0, the Public Hearing was closed. <br />Chair Howard asked the City Planner if the eastside curb improvement would be on the north side <br />as well. City Planner Gundlach explained the submitted plans were conceptual, but curbing would <br />potentially be improved on the north side. Commissioner Schiferl questioned if the applicant <br />would be required to come before the planning commission when it comes time to improve the <br />landscaping. City Planner Gundlach responded landscape improvements would not require <br />council approval. Commissioner Danger asked Mr. Sandquist if additional lighting plans have <br />been submitted. Mr. Sandquist assured Commissioner Danger the lighting will meet required <br />standards. Commissioner Schiferl questioned if a condition could be added to address the lighting <br />plan. City Planner Gundlach responded a recommendation could be added, however there is <br />nothing in the Zoning Code that would require a lighting plan. When the applicant obtains their <br />Electrical permit, the lighting plan would be reviewed. Commissioner Danger asked if the Zoning <br />Code addresses parking lot lighting, City Planner Gundlach confirmed it does not; however the <br />Building Code may have a requirement. <br />Motion by Commissioner Schiferl, seconded by Commissioner Danger to make a motion to approve staff <br />recommendation with the following changes: <br />
