�4pp�'�ved <br />• Make condition number 3 broader in terms of requiring the existing garage to be improved. <br />• Alighting plan be submitted and approved by City Staff. <br />Approved 6-0 <br />(B) Allen Lenz requests consideration of a Special Use Permit to permit operation of a <br />motorized scooter sales and repair business, including outdoor display of 5-7 scooters at <br />any given time, at 833 3rd ST SW, Suite #6. <br />Because the applicant was not at the meeting, City Planner Gundlach recommended giving the <br />presentation to the commission with the option of tabling the request if there are questions of the <br />applicant. The applicant is requesting a Special Use Permit to permit operation of a motorized scooter <br />sale, lease, and repair business at 833 3`d ST SW, Suite #6. Any type of vehicle sales requires review and <br />approval of a Special Use Permit within the industrial district. The tenant space is approximately 2,400 <br />SF. The applicants proposed business includes leasing and the sale of new and used gas operated, <br />electric, and hybrid moped scooters ranging from 50cc to 300cc in size. Seasonally, up to 7 scooters <br />would be displayed outdoors during business hours. Lastly, the applicant will provide scooter repair <br />services on site and during non -business hours nothing will be stored outdoors. <br />Staff has met with the applicant regarding this use and has indicated no similar use exists within the City. <br />This is important as it is not fully understood what issues may be of concern related to this business. <br />Staff has also inquired about the applicant's intent to obtain a dealers license to sell new and used <br />scooters. The applicant has been informed by the state they would issue the exact same license for <br />scooters as would be issued for vehicles. Knowing this, any approval of a Special Use Permit should be <br />strictly conditioned limiting the business to moped scooters ranging from 50cc to 300cc. Staff has <br />communicated this intend to the applicant who is in agreement to a tightly conditioned Special Use <br />Permit. Lastly, the applicant has been informed of Building Code requirements that will be imposed <br />related to the repair function of the business. <br />Commissioner Nichols-Matkaiti questioned the issue of test driving; City Planner Gundlach reported <br />Public Safety has reviewed the request and had no concerns. Mayor Jacobsen questioned if a motorcycle <br />endorsement is required for the vehicles, City Planner Gundlach replied anything over 50 cc requires an <br />endorsement. Commissioner McPherson questioned the possibility of a trade in exceeding 300 cc, Ms. <br />Gundlach confirmed they would not be licensed to sell any vehicle over 300 cc. <br />Commissioner Schiferl questioned if hours of operation should be included in approval. Ms. Gundlach <br />stated hours of operation are typically imposed when the business is near a residential district. <br />Commissioner McPherson questioned if there were any restrictions on noise. Ms. Gundlach replied <br />repairs will be done indoors, any complaints would be addressed through the nuisance code. <br />Motion by Commissioner Schiferl, seconded by Commissioner Zisla to close the Public Hearing. <br />Approved 6-0, the Public Hearing was closed. <br />Motion by Commissioner Schiferl, seconded by Commissioner Zisla to approve staff <br />recommendation.
