Allen Lenz requests approval of a Special Use Permit to permit operation of a <br />motorized scooter sales and repair business, including outdoor display of 5-7 scooters <br />' at any given time, at 833 3d ST SW, Suite #6. Report No. 10-142. Resolution No. <br />10-037. <br />City Planner Janice Gundlach reported the applicant is requesting a Special Use Permit to permit <br />operation of a motorized scooter sale, lease, and repair business at 833 3rd ST SW, Suite #6. Any <br />type of vehicle sales requires review and approval of a Special Use Permit within the industrial <br />district. The tenant space is approximately 2,400 SF. The applicants proposed business includes <br />leasing and the sale of new and used gas operated, electric, and hybrid moped scooters ranging <br />from 50cc to 300cc in size. Seasonally, up to 7 scooters would be displayed outdoors during <br />business hours. Lastly, the applicant will provide scooter repair services on site and during non- <br />business hours nothing will be stored outdoors. Staff has also inquired about the applicant's <br />intent to obtain a dealers license to sell new and used scooters. The applicant has been informed <br />by the state they would issue the exact same license for scooters as would be issued for vehicles. <br />Knowing this, any approval of a Special Use Permit should be strictly conditioned limiting the <br />business to moped scooters ranging from 50cc to 300cc. Staff has communicated this intend to <br />the applicant who is in agreement to a rightly conditioned Special Use Permit. The applicant has <br />been informed of Building Code requirements that will be imposed related to the repair function <br />of the business. The Planning Commission held a Public Hearing on May 18`", no public <br />testimony was given, and the Planning Commission unanimously recommended approval. <br />Staff recommends approval subject to the following conditions: <br />1. All sales and leasing are limited to motorized, gas operated moped scooters ranging from <br />50cc to 300cc, including electric and gas hybrids. <br />2. No more than 7 scooters may be displayed outdoors at any given time and are confined to no <br />more than 3 parking spaces within the parking lot located on the east side of the building. All <br />scooters displayed outdoors must be in good repair. No signs, flags, streamers, banners, or <br />the like may be displayed outdoors (exception is permanent wall sign). <br />3. All scooters must be stored indoors during non -business hours. <br />4. All repair functions of the business must be conducted entirely indoors. <br />5. The Building Official must conduct an inspection to ensure all Building Code requirements <br />have been met prior to opening for business. <br />Councilmember Phillips reported the Planning Commission questioned if motorcycles <br />would be sold. Allen Lenz stated he is not intending to sell larger motorcycles. City Planner <br />Gundlach stated the City is limiting approval to 50-300 cc. Mayor Jacobsen questioned if a <br />motorcycle endorsement is required over 50 cc? Mr. Lenz confirmed that is correct. Test drives <br />will not be permitted, and a permit would be required to drive the cycle off the lot. <br />Motion by Councilmember Phillips, seconded by Councilmember Samuelson to approve <br />the Special Use Permit to permit operation of a motorized scooter sales and repair business, <br />including the outdoor display of 5 -7 scooters at any given time at 833 3rd ST SW, Suite #6. <br />4 Ayes, 0 Nays -Motion Carried <br />Page 4 of 6 <br />Council Business <br />1.
