the city that works For you <br />July 1, 2010 <br />BICENTENNIAL POND RESIDENTS <br />RE: City Council Worksession to Discuss Bicentennial Storm Sewer Improvement Tax District <br />On Tuesday, July 13, 2010 at 5:30 p.m. at City Hall, the City Council will discuss the <br />Bicentennial Pond Storm Sewer Improvement Tax District. Last year, on December 8, 2009, a <br />resolution was made by City Council to consider revising the taxing district boundaries for the <br />upcoming 2011 assessment. This is the fust Council Meeting on this topic. At the Worksession <br />staff will provide information to the Council regarding history, how the district boundaries were <br />established, project funding, and the recent reluctance of some of the neighbors to still continue <br />on with the district. <br />This meeting is not a scheduled public hearing and you may not have an opportunity to speak <br />regarding the district. However, if you have strong feelings and you want the Council to be <br />aware of it, please send me an email at grant.wyffelsknewbrightomnn.gov or write me a letter <br />before the next Worksession and I will pass this information along. This meeting is an <br />informational meeting only, no decisions regarding the district will be made at this meeting. <br />The process moving forward will be discussed at the Worksession. Before the Storm Sewer <br />Improvement Tax District boundaries can be changed, the City must conduct a public hearing <br />where anyone who wishes to be heard can provide testimony. If the Council agrees to hold a <br />public hearing on this matter, we will notify you of the date and time of the hearing. <br />The following is from State Statute regarding the process to establish or change the district: <br />"The governing body of a municipality may by ordinance adopted by a two-thirds vote of all of its <br />members, establish within its territorial limits a storm sewer improvement tax district. The ordinance shall <br />describe with particularity the territory or area within the municipality to be included within the district. No <br />such ordinance shall be adopted until after a public hearing has been held on the question. A notice of the <br />time, place and purpose of the hearing shall be published for two successive weeks in the official <br />newspaper of the municipality or in a qualified newspaper of general circulation in the municipality and the <br />last notice shall be at least seven days prior to the day of the hearing.
