The applicant agrees not conduct a home occupation within the goings structure. <br />2. The exterior materials and colors for the proposed accessory structure shall match and/or <br />compliment The home. <br />3. The applicant is responsible for providing both winter and sumorr r vegetative screening on the <br />applicant's side of the southerly lot line should the existing vegetative screening on the neighboring <br />lot ever be removed. <br />4. The applicant implements the Landscape Plan as proposed for the east side of the proposed building. <br />•Legislative History: June 15, 2010: The Planning Commission opened the public hearing and <br />discussed the proposed accessory, smmtme. The Planning Commission expressed concerns regarding <br />the size of the structure and its visual impact when viewed from the lake. One resident expressed <br />ncemsthatpdvatecovenantsmayexistprobibifingtceswcnue. Because the applicant wasn't present <br />is address Neu concerns, me Commission tabled action to the July 20, 2010 Planning Commission <br />meeting. <br />July 20,2010: The Planning Commission continued the public hearing. No residents attended the <br />meeting or expressed concerns to City stab. The applicant addressed the Planning Commission's <br />concerns from the June 15th meeting regarding private storage needs. Staff provided information to Ne <br />Commission suggesting that if covumenr; exist they have int been historically enforced and that it wasn't <br />The City's role to enforce private covenants. The Commission continued to express concems regarding <br />the ability to screen the stnhcmre so as to mitigate its visual imposed. The Commission recommended two <br />conditions that would rum to replace vegetative screening to the south if it were removed and to require <br />submittal of a Landscape Plan for the outclass side of the structure prior to City Council consideration. <br />The applicant submitted a Landscape Plan psee attached), which staff finds acceptable, and condition N4 <br />above ensures it will he implemented. <br />Financial Impact: None <br />Explanation: The applicant is requesting a Special Use Permit to allow concoction of a 24' x 44' <br />demcbed postage totally 1,056 SF. The garage would be located in dm backyard, which is the southeast <br />•side of the property, and would he setback 50' from the lake and 5' fiom the side lot line.
