RESOLUTION NO. <br />10-048 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />As, an application has been made by Jeff Van Der Wal to permit construction of a 24' x <br />44' etached garage whereby the total square footage would exceed 624 s.f. at 1,056 SF at <br />18 15ih AVE NW, and <br />/HE I EAS, the procedural history of the application is as follows: <br />1. application for a Special Use Permit was received on May 28, 2010. <br />2. a Planning Commission, pursuant to published and mailed notices, held a public hearing <br />n June 15, 2010 and all present were given a chance to freely speak at the hearing. <br />3. he Planning Commission opened the public hearing on June 15, 2010 and tabled action to <br />I ie July 20, 2010 meeting. <br />4. he Planning Commission continued the public hearing on July 20, 2010. <br />5. he Planning Commission recommended approval of the Special Use Permit request subject <br />conditions. <br />6. he City Council considered the request on July 27, 2010. <br />/HE I EAS, the Planning Commission and City Council make the following Findings of Fact with <br />res ct to the Special Use Permit (SP2010-005): <br />1. he property is zoned R-1, Single Family Residential. <br />2. e property is guided in the Comprehensive Plan for Low Density Residential. <br />3. e property is legally described as follows: <br />Lot 9, Block 1, WINDWARD TERRACE, Ramsey County, Minnesota <br />4. he applicant has proposed to construct a 24' x 44' detached garage whereby the square <br />otage would exceed 624 square feet at 1,056 SF. <br />5. lie Planning Commission considered the proposal in accordance with Zoning Code Section <br />-530 (1) (E) which requires approval of a Special Use Permit for any accessory building in <br />xcess of 624 square feet. <br />6. a Planning Commission considered the proposed Special Use Permit in accordance with <br />oning Code Section 4-530 (1) (K) which requires that the garage meet the following <br />Roof and exterior color and material must be consistent and complimentary with the <br />principal structure. <br />If deemed necessary by the City Council, landscape screening shall be provided to lessen <br />visual impact from adjacent properties. <br />No commercial or home occupation activity shall be conducted within the accessory <br />building. <br />7. he Planning Commission reviewed the proposal in accordance with the following Special <br />se Permit conditions of Zoning Code Section 8-130: <br />Development\7-27-2010\SP2010-005 (Van Der Wal) - RESOLUrION.doc <br />
