That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />8. a Planning Commission found all Special Use Permit criteria of Sections 4-530 and Section <br />30 to be met due to the following: <br />The structure will match the home. <br />The property is large enough to support the proposed 1,056 SF accessory building. <br />Existing vegetation to the south will be preserved, providing for screening from the most <br />impacted neighbors to the south. <br />The applicant agrees to landscaping conditions preserving vegetation on the south side of <br />the structure as well as providing new landscaping on the east side of the structure. <br />The applicant intends to use the structure for storage of personal items only. <br />The proposed accessory structure maintains the same setback from the lake as a principal <br />structure would be required to meet. <br />THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application <br />r a Special Use Permit (SP2010-005) is hereby approved, subject to the following <br />1. a applicant agrees to not conduct a home occupation within the garage structure. <br />2. he exterior materials and colors used for the proposed accessory structure match and/or <br />ompliment the home. <br />3. he applicant implements the Landscape Plan as proposed for the east side of the proposed <br />!d this 27d' day of July, 2010. <br />e�� City Clerk <br />4i�7 Dave Jac sen, Mayor <br />10\Community Development\7-27-2010\SP2010-005 (Van Der Wap - RESOLUTION.doe <br />
