July 27, <br />to the Commission suggesting that if covenants exist they have not been historically enforced <br />and that it wasn't the City's role to enforce private covenants. The Commission continued to <br />express concerns regarding the ability to screen the structure so as to mitigate its visual <br />'impact. The Commission recommended two conditions that would aim to replace vegetative <br />screening to the south if it were removed and to require submittal of a Landscape Plan for the <br />east/lake side of the structure prior to City Council consideration. The applicant <br />submitted a Landscape Plan, which staff finds acceptable. <br />Councilmember Phillips questioned if the roof overhang encroaches on the setback. City <br />Planner Gundlach explained the roof overhang can be two feet in the setback. <br />Mayor Jacobsen reported at the recent Planning Commission meeting, there was concern <br />related to the size of the structure, and for that reason the additional screening was <br />recommended. Councilmember Bauman questioned the reason for the requirement of the <br />screening. City Planner Gundlach reported the Planning Commission specifically <br />recommended the condition. Councilmember Burg was pleased to see the landscape plan <br />requirement. Councilmember Phillips agreed with Councilmember Bauman, stating it should <br />not be up to the property owners to be responsible for his neighbor's trees. <br />Motion by Councilmember Phillips, seconded by Councilmember Bauman to <br />adopt the attached Resolution, approving the Special Use Permit, subject to the <br />following four conditions: <br />1. The applicant agrees not to conduct a home occupation within the garage structure. <br />2. The exterior materials and colors for the proposed accessory structure shall match <br />and/or compliment the home. <br />' 3. The applicant implements the Landscape Plan as proposed for the east side of the <br />proposed building. <br />5 Ayes, 0 Nays -Motion Carried <br />Commission Liaison Reports, Announcements and Updates <br />Dean Lotter <br />City Manager Lotter reported the Attorney General has informed the City that New Brighton <br />will not be part of a three party agreement with the Minnesota Pollution Control Agency and <br />Ashland Oil. Also reported was the site will move from Superfund to the Petroleum clean-up <br />program: clean up is expected this winter. <br />The Ramsey County Library Board meeting was attended. The architects report looked at the <br />costs associated with relocating to the FSC or bringing the current site in Arden Hills up to <br />current code through renovations. <br />Gina Bauman <br />Councilmember Bauman reported the July EDC meeting was cancelled.
