<br />'tI <br /> <br />!. <br /> <br />ii, <br /> <br />RESOLUTION No. 01-045 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKfNG FfNDINGS OF FACT AND RECOMMENDATION OF APPROVAL OF SP 01-06. <br /> <br />WHEREAS, an application for a special use permit has been made by D.L. Beach to allow the addition of <br />1,830 square feet to a gasoline sales business to be located at 2251 Long Lake Road. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a special use permit was filed with the City of New Brighton on April 20, , <br />2001. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on May 15,2001, and all persons present at the hearing were given an opportunity to be <br />heard. <br />3. The Planning Commission unanimously recommended approval (6-0) of the Special <br />Use Permit at a Public Hearing on May 15,2001. <br />4. The City Council considered the application at the regular meeting of May 22, 200 I. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to <br />SP 01-06: <br /> <br />1. The subject site is zoned B-3, General Business. <br />2. The applicant is proposing to provide gasoline sales and light mechanical service. <br />3. Gasoline sales are a use allowed by special use in the B-3 District. <br />4. The applicant is proposing to expand the existing structure for work area and storage <br />improvements to the site. <br />5. The trash container will be relocated within the new addition. <br /> <br />6. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use shall <br />be recommended by the Planning Commission unless such shall find: <br /> <br />1. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general <br />public. <br />2. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish <br />and impair property values within the neighborhood. <br />3. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />4. That adequate utilities, access roads, drainage and/or necessary facilities have been <br />or are being provided. <br />5. That the .\pecial use shall. in all other respects, cO'1form to the applicable regulations <br />of the district in which it located. <br /> <br />7.
