Approved <br />PLANNING COMMISSION PROCEEDINGS <br />Regular Meeting — September 21, 2010 7:00 p.m. <br />Present: Commissioners Bruce Howard, James Alvey, Verne McPherson, Steve Danger, Paul Zisla <br />Norm Schiferl and Erin Nichols-Matkaiti <br />Absent: None <br />Also Present: Mayor Dave Jacobsen, David Phillips-Councilmember, Janice Gundlach-City Planner, <br />and Katie Bruno -Office Assistant. <br />Agenda Review: No Changes. <br />Minutes: Minutes from August 17, 2010 were presented and approved. <br />Council Action: Councilmember Phillips reported the Ramsey County Library Board has recommended <br />the library be relocated to the New Brighton Family Service Center. The Ramsey County Board of <br />Commissioners will vote on the proposal at the October 5th or October 12th meeting. <br />Council recently approved a term sheet with Stuart Companies for a 120 unit market rate rental property <br />in the Northwest Quadrant. <br />Public Hearing: <br />(A) Grandview Custom Homes, on behalf of Tho Nguyen requests a Nonconforming Use Permit to <br />allow existing front yard and rear yard setbacks less than required by code to remain in <br />conjunction with construction of a 24'x 26' addition at 742 2nd AVE NW. <br />City Planner Gundlach reported the applicant is requesting a Nonconforming Use Permit to allow a 24'x <br />26' addition to the rear of the existing home, which maintains a 6' setback to the front lot line when 30' is <br />required. Additionally, a second nonconformity exists where the existing detached garage is setback 4' <br />from the rear lot line when 5' is normally required. The proposed addition will meet all required side and <br />rear yard setbacks. The applicant has recently demolished a 15'x 20' addition in the area where the new <br />addition will be placed as it in immense disrepair. <br />Staff recommends approval of the request as submitted, subject to the following condition: If the <br />detached garage is removed in its entirety, it is rebuilt to comply with the 5' rear yard setback. <br />56 Notices were sent out, no inquiries were received. Commissioner Nichols Matkaiti questioned the <br />time limit imposed if a garage was added. City Planner Gundlach stated a building permit would have to <br />be obtained within 180 days. If a building permit is applied for, City Staff would review to be sure <br />compatibility requirements are met. <br />Commissioner Danger questioned the reason the property has a 6 foot setback. City Planner Gundlach <br />reported this house is in an older part of the City and predates the Incorporation of New Brighton. <br />Chair Howard asked for comments, there were none. <br />Motion by Commissioner Schiferl, seconded by Commissioner Zisla to close the Public Hearing. <br />
