Approved <br />7-0 Motion carried <br />Motion by Commissioner Schiferl, seconded by Commissioner McPherson to approve the staff <br />recommendation. <br />7-0 Motion carried <br />(B) Samir and Elena Elkhoury request a Site Plan and Special Use Permit to permit the <br />redevelopment of 850 County Road D W with a 12,175 SF multi -tenant commercial building, <br />including a drive-thru facility. <br />The applicant is requesting a Site Plan and Special Use Permit to redevelop the former Godfather's Pizza <br />site at 850 County Road D W. The applicant intends to demolish the existing 3,655 SF restaurant and <br />reconstruct a 12,175 SF multi -tenant commercial building, to include a drive-thru facility. A Site Plan <br />approval is required for all new commercial construction and a Special Use Permit is required <br />specifically for the drive-thru facility. The applicant intends to construct and operate a 6,775 SF liquor <br />store and construct three additional tenant spaces of 1,800 SF each. The applicant operates a liquor store <br />in the City of St. Paul and has obtained the necessary liquor license from Public Safety for this property. <br />The uses for the three other tenant spaces are unknown at this time. An overview of the proposed site <br />plan was displayed, Staff reported generally all criteria have been met. Staff offers the following <br />highlights: A less than 1' side yard setback is proposed along the western lot line. Discrepancy regarding <br />meeting a 5' parking lot setback along the western lot line — applicant expressed intent to meet setback. <br />60 parking stalls are required for a multi -tenant commercial building and 60 parking stalls are proposed. <br />One loading facility is proposed for the liquor store with all other deliveries occurring through the front <br />or rear doors. Landscaping issues have yet to be finalized. <br />A Special Use Permit is required for the drive-thru facility. Zoning Code Section 11-020(10) outlines 10 <br />conditions that must be met. Staff finds the proposed drive-thru meets all standards, however, a <br />crosswalk should be added for pedestrian safety. Staff also considered the general health, safety, and <br />welfare concerns of Section 8-130 and find all criteria have been met. <br />15 Notices were sent out, no inquiries were received. Staff recommends approval of the Site Plan and <br />Special Use Permit, subject to the following conditions: <br />1)Implementation of the recommendations of the City Engineer. 2)A 5' parking lot setback is maintained <br />along the side (west) lot line. 3)The applicant attains any necessary temporary construction easement <br />from the adjacent landowner in order to realize the less than 1' side yard building setback as proposed. <br />4)The applicant submits a Lighting Plan at the time of building permit for review and approval of the <br />City Planner.5) Separate Sign Permits will be required for all signs, permanent or temporary. <br />6)A pedestrian crosswalk is included, delineating a safe route from the 9 parking spaces south of the <br />drive-thru lane across the drive-thru lane. 7)The applicant and staff consider the landscaping comments <br />and devise any necessary revisions to the Landscape Plan prior to City Council consideration. <br />Commissioner Schiferl questioned the circulation through the parking lot. City Planner Gundlach <br />responded access will remain exactly the same as currently. Commissioner Schiferl also questioned if a <br />permanent easement is necessary for access to the left side of the building. City Planner Gundlach stated <br />that will be something the applicant will have to work out with the adjacent property owner. <br />Commissioner Schiferl suggested talking to the landscape consultant to include variety of trees. <br />Commissioner Schiferl suggested adding a condition requiring adequate space for recycling containers be <br />
