Staff would recommend that a crosswalk be painted from the 10 parking stalls at the <br />south end of the site, north toward the front door. <br />G. The drive-thru use may be limited so as not to unreasonably interfere with adjacent <br />and nearby uses. Limits of use may include, but is not limited to, prohibition of <br />certain uses that may be inappropriate due to their demand on parking and stacking <br />needs, such as fast food establishments. <br />Based on the parking constraints on site, staff would limit the Special Use Permit to <br />the applicant's use: Dairy Queen/Orange Julius. The concern is that this site is not <br />appropriate for a higher demand fast food type establishment <br />H. The following hours of operation shall be imposed: <br />1. For properties abutting R-1, R -IA and R-2: Sunday — Thursday 7:00 AM — 9:00 <br />PM and Friday — Saturday 7:00 AM —10:00 PM. <br />2. For properties abutting all other zoning districts: Sunday — Thursday 6:00 AM — <br />11:00 PM and Friday — Saturday 6:00 AM —12:00 PM. <br />The City Council may impose different hours of operation based upon specific <br />characteristics of adjacent and nearby uses. <br />The applicant has not indicated a desire to operate beyond the listed hours of <br />operation in this section, nor would staff recommend additional hours be allowed. <br />I. Any menu/ordering signage interior to the site with an intercom shall not be audible <br />from residentially zoned property and if illuminated shall be directed away from <br />residentially zoned property. <br />The proposed menu -board location is approximately 250' from the nearest residential <br />home. Also, this site and the nearest residential home have a grade separation of <br />approximately 15' with the commercial site being low and the residential home being <br />high. With the distance, both horizontal and vertical, combined with existing tree <br />cover it is unlikely the residential home to the north will hear the speaker from the <br />drive-thru menu board. Lastly, the menu board should be directed south/southwest to <br />ensure it won't be audible from the nearest residential home. <br />J. Fencing and or landscaping may be required to shield head -light illumination from <br />adjacent and nearby areas. <br />Staff doesn't find any fencing or landscaping to be necessary as any head -light <br />illumination from the drive-thru lane will be directed towards commercial property <br />and/or busy County roadways. <br />Additionally, the following general health, safety and welfare standards of Zoning Code Section <br />8-130 shall be met: <br />A. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of the general <br />public. <br />
