PLANNING COMMISSION PROCEEDINGS <br />Regular Meeting — October 19, 2010 7:00 p.m. <br />Present: Commissioners Bruce Howard, James Alvey, Verne McPherson, Steve Danger, Paul Zisla <br />Norm Schiferl and Erin Nichols-Matkaiti <br />Absent: None <br />Also Present: Mayor Dave Jacobsen, Janice Gundlach-City Planner, and Katie Bruno -Office Assistant. <br />Agenda Review: No Changes. <br />Minutes: Minutes from September 21, 2010 were presented and approved with the following addition <br />suggested by commissioner Alvey: Page 5 to include "have been made". <br />Council Action: Mayor Jacobson extended his gratitude and appreciation for the work the Planning <br />Commission has been doing. It was reported that the Ramsey County Board of Commissioners have <br />approved the relocation of the Arden Hills Library to the Family Service Center, Mayor Jacobsen stated <br />the reviewing of the zoning code is timely; specifically the sign ordinance; as the County Board is <br />anticipating signage for the library. <br />Public Hearing: <br />(A) Continuation:Belair Excavating requests consideration of a Zoning Code Amendment, Site Plan, <br />and Special Use Permits to allow adoption of an Environmental Constraint Overlay District as a <br />means to permit an aggregate recycling/crushing operation and to allow a yard waste transfer site <br />at 2200 Old Highway 8 NW. <br />City Planner Gundlach reported the following history; September 21, 2010 the Public Hearing was <br />opened, The discussion was tabled to tonight's meeting to allow staff and the applicant to gather <br />additional information. Staff and the applicant have prepared and/or submitted that information, which <br />addresses concerns raised at the September 21st meeting. The City Planner and a City Engineer met on <br />site to discuss details related to the berm -. Staff has also discussed additional information with the <br />applicant — specifically related to a license & hours of operation requirement & more details will be <br />provided. <br />A revised ordinance was reviewed & includes 10 yard waste transfer related conditions including volume <br />& height limitations, screening, 24 hour maximum stay, odor, dust control, blowing debris control, noise, <br />& contingency planning. Also includes a license requirement & more restrictive hours of operation. <br />RCWD will require a permit addressing water quality issues. The berm will be shifted to the south to <br />preserve existing drainage systems. <br />A series of questions from the prior meeting were addressed. The applicant is proposing constructing a <br />40 ft x 40 ft x 6ft tall confinement area, constructed of ecology blocks, this would allow the applicant to <br />cover the piles as necessary. 151 notices were sent out for the continuation of the Public Hearing, one <br />inquiry for further information was received. City Planner Gundlach reported Belair would like 3 years <br />to construct the berm. Staff feels this is unreasonable and would recommend 1 year. Staff would also <br />recommend that the license for the aggregate crushing use be held until the berm is fully constructed. <br />1 <br />
