Councilmember Phillips would like to ask the applicant if those <br />particular stalls are needed. <br />City Planner Gundlach reported that the applicants are requesting consideration of a Special Use <br />Permit to permit construction of a drive-thru facility at 2200 Silver Lake Road. This property <br />consists of an existing multi-tenant commercial building, with the applicant wanting to occupy <br />the most southern tenant space. The only actual improvements necessary for the drive-thru <br />include a small driveway connection between the front and back parking lots and the actual <br />drive-thru window on the southern facade of the building. Also required is a Nonconforming <br />Use Permit to resolve some existing nonconforming parking issues on site. The Planning <br />Commission considered the request and held a public hearing. Public testimony was given by <br />one individual expresses support of the project. The Commission voted unanimously to approve <br />the requests subject to five conditions. <br />Councilmember Phillips noted he would be more concerned with the reduction of parking <br />on City property as he would with the setback requirement between two commercial businesses. <br />City Planner Gundlach reported there may have been an error in some prior surveys. The Property <br />Owner has expressed concern with retaining a tenant, and has provided a plan without` <br />using the seven northern parking stalls in the questionable area. Councilmember Phillips <br />suggested the Property Management Company work with City Staff to bring back a <br />resolution in February or March 2011. <br />Mike Dey, representing the Property Management Company expressed his appreciation to the <br />Council and reported an understanding of the problem with the area and intend to resolve the issue <br />Councilmember Bauman stated this was a fantastic venture, and feels the temporary solution <br />is a good one. <br />Councilmember Burg questioned if it could be set up to withhold a Certificate of Occupancy <br />until a resolution is reached. City Attorney LeFevere stated if the assumed property line is <br />where the survey shows it to be, and if Council is satisfied with a 0' 'setback, this is a complete <br />deal, no matter how the property is resolved. <br />Councilmember Burg asked if the number of employees is known. Don Fitch (applicant) <br />responded he anticipates 30 employees, and hopes to be open for business April 1, 2011. <br />Motion by Councilmember Phillips, seconded by Councilmember Bauman to approve the <br />resolution malting Findings of Fact and approving a Special Use Permit and Nonconforming <br />Use Permit for the Dairy Queen / Orange Julius with the addition of the following <br />condition: <br />The revised site plan presented at the Council meeting is incorporated with recognition that the <br />Council approves a 0' parking lot setback at the northeast corner of the site and with the provision <br />that the applicant presents othersite plans for future council consideration should additional land <br />be acquired in the northeast corner of the site. <br />5 Ayes, 0 Nays-Motion Carried <br />Commission Liaison Reports, Announcements and Updates Commission <br />Liaison Reports, <br />Dean Lotter Announcements <br />City Manager Lotter reported Staff met with Ramsey County to discuss the lease arrangement, and Updates <br />and establish an RFP panel for the Library. The RFP is due January 5th, with a selection date of <br />January 14th. Mr. Lotter reported a more detailed calendar would be coming in the future. <br />It was reported the City Of New Brighton obtained second place for their participation in <br />National Night Out 2010.
