111) Of
Report Number 11-012
Agenda Section VI-11
the city that works for Council Meeting Date January 11,2011
REQUEST FOR COUNCIL CONSIDERATION
ITEM DESCRIPTION: Consideration of a Zoning Code Amendment amending Zoning Code Section
7-230(7)pertaining to maximum gross floor areas of a Planning Unit Development within the Northwest
Quadrant Redevelopment Area.
DEPARTMENT HEAD'S APPROVAL: Grant Fernelius, Community Development Director
CITY MANAGER'S APPROVAL:
No comments to supplement this report ,4 Comments attached
15.99 Deadline: not applicable
Recommendation: Adopt the attached Ordinance amending Zoning Code Section 7230(7).
Legislative History: December 21, 2010: The Planning Commission considered the request and held a
public hearing. No testimony was given. The Commission recommended adoption of the proposed
Ordinance as drafted by staff.
Financial Impact: none
Explanation: City staff is requesting a Zoning Code Amendment to Section 7-230(7) concerning
maximum gross floor areas for projects seeking Planned Unit Development approval. The existing
language of Section 7-230(7) limits the maximum gross floor area for all buildings to 45% of the total
land area. For projects within the Northwest Quadrant Redevelopment Area this maximum is too low
for the types of projects the City desires. Thus, staff has proposed an amendment that gives the City
Council flexibility to allow a higher maximum gross floor area for projects within the Northwest
Quadrant Redevelopment Area. As always, the underlying standards of the NWQ, Northwest Quadrant
zoning district will predominately guide development. It should be noted that without this change, the
proposed Stuart project could not proceed.
The practice of amending the City Zoning Code to meet the Northwest Quadrant's needs is not a new
concept. The City adopted the NWQ, Northwest Quadrant zoning district to codify some of the design
guidelines established for redevelopment. While the goal remains to use this ordinance to
predominately guide redevelopment efforts within the Northwest Quadrant, City staff is finding that the
ordinance doesn't meet the needs of every project. Noting this, City staff has used the Planned Unit
Development (PUD) tool to overcome some of these issues. In fact, the PUD ordinance has been
amended previously to allow flexibility on some standards for projects within the Northwest Quadrant.
A past example is a setback standard of Section 7-230(8)(B). Staff feels this proposed amendment
related to density is needed in order to facilitate a project in the immediate future (The Stuart Company)
as well as future projects. Staff recommends adoption of the attached Ordinance.
Costs and Funding: Not applicable
Janice Gundlach
City Planner
