AGREEMENT FOR PROSECUTION SERVICES <br /> BETWEEN <br /> CITY OF NEW BRIGHTON <br /> AND <br /> THOMAS R. HUGHES <br /> This agreement effective 1st day of January, 2011, by and between the City of <br /> New Brighton, hereinafter called "City" and Thomas R. Hughes, hereinafter called <br /> "Prosecutor" witnesseth <br /> WHEREAS, City has need of the services of an attorney at law licensed to practice <br /> law in the State of Minnesota to advise and represent City in municipal prosecutions, <br /> and <br /> WHEREAS, Prosecutor is licensed to practice law in the State of Minnesota and is <br /> experienced in and familiar with all phases of municipal prosecution and is desirous of <br /> providing the prosecution services required by City, and <br /> WHEREAS, the parties hereto desire to enter into a written agreement to set forth <br /> the terms, conditions, compensation, duties, responsibilities an other matters relating to <br /> Prosecutor providing services to City. <br /> NOW, THEREFORE, it is agreed by and between City and Prosecutor that City <br /> does hereby retain and designate Prosecutor as the New Brighton City Prosecutor, <br /> effective January 1 , 2011 for one year, and Prosecutor does hereby accept the position <br /> of New Brighton City Prosecutor and agrees to perform the requirements of that <br /> position, all on the terms and conditions hereinafter set forth. <br /> A. Designated Attorney. <br /> 1 . Thomas R. Hughes is hereby designated as Chief City Prosecutor and shall <br /> conduct all prosecutions for city unless unable to do so because of illness, <br /> vacation, schedule conflict or other justifiable reason. <br /> 2. In the absence of Thomas R. Hughes another attorney will be assigned as <br /> prosecutor by Thomas R. Hughes. The City reserves the right to disapprove <br /> such prosecutor. <br /> B. Retainer. <br /> 1 . For all prosecution services, City shall pay Prosecutor a monthly retainer in <br /> the sum of $4,236.00 for 2011.. <br /> 2. In consideration of the retainer, Prosecutor hereby agrees to perform and <br /> furnish the following legal services: <br /> a. Advise and train all City departments with regard to laws relevant to their <br /> department and the prosecution of criminal cases as requested. <br /> b. Consult with citizens on complaints of ordinance and statute violations. <br />
