c. Preparation of criminal complaints. <br /> d. Evaluate all cases for the appropriate charge and correct procedure to <br /> be followed. <br /> e. Represent the City in all pretrial motions and pretrial conferences in <br /> criminal matters. <br /> f. Perform legal research and writing necessary for criminal cases. <br /> g. Notify all witnesses of necessary court appearances. <br /> h. Try all criminal court trial and jury cases. <br /> i. Examine, evaluate, prepare briefs and argue all appeals to the Ramsey <br /> County District Court and Minnesota Supreme Court. <br /> j. Attend court sessions in other divisions where required by the court. <br /> k. Perform legal services for motor vehicle forfeitures under Minnesota <br /> Statutes 169A.63 and be compensated pursuant to statute. <br /> C. Term of Contract- Termination. <br /> 1 . This contract between City and Prosecutor shall continue in full force and <br /> effect until amended in writing by the mutual agreement of the parties hereto <br /> or terminated in accordance with the conditions hereinafter contained. <br /> 2. Either party to this contract may terminate the same upon 60 days written <br /> notice to the other party directed to the last day of a calendar month. <br /> 3. City may terminate this contract without advance notice in the event <br /> Prosecutor is guilty of malfeasance or misfeasance in office, has the right to <br /> practice law in the State of Minnesota suspended, or disbarred, or is found <br /> guilty of a felony. <br /> 4. Prosecutor may terminate this contract without advance notice in the event <br /> performance becomes impossible due to physical or mental impairment or <br /> because continued performance of the contract would be contrary to law. <br /> - 2 - <br />
