A Ramsey County branch library will be going in at the Family Service Center. An RFP is going <br /> out for the construction that will be needed. Additional parking may be added at the Family <br /> Service Center with Ramsey County paying for this, if needed. The new library will probably be <br /> ready to open in September or October 2011. <br /> Old Business <br /> Review of Vicious Animal Ordinance <br /> Director Jacobson began by reviewing the concern to define vicious when a dog bites another <br /> dog. In the current animal ordinance, there are three things needed to declare an animal vicious: <br /> inflicted substantial bodily harm on a human being without provocation, killed a domestic animal <br /> without provocation, and been involved in two or more unprovoked biting incidents involving <br /> humans or domestic animals within one year. <br /> If an animal bites two times within one year, the animal owner is cited for a vicious animal. The <br /> court process would then decide the pet's disposition. <br /> Various ordinance language options were reviewed and discussed. Commissioner Bredenbeck <br /> asked if the language should be definite or more open. Which is easier to enforce? <br /> Commissioner Woods would like the revised ordinance wording to proceed after one biting <br /> incident. Commissioner Bredenbeck would like to see wording whether the animal is on their <br /> property or off their property. Commissioner Schumann asked how to revise the ordinance to <br /> incent an animal owner to be responsible. Director Jacobson noted that the maximum penalty <br /> would be a Misdemeanor offense which could result in 90 days in jail or a $1,000 fine. <br /> Commissioner Woods made a motion to model our animal ordinance after the Fridley City Code <br /> 100.11, Sub 1, include that this applies to animals that bite other animals while off their property, <br /> remove any language that states the bites must have occurred within one year of a previous bite, <br /> and prohibits an animal that has been deemed to be vicious or dangerous in another city to be <br /> allowed to move into New Brighton. Commissioner Allen seconded. Motion carried. <br /> Director Jacobson asked Mr. McQuillan if he would be interested to share his story with the <br /> Bulletin after the revised ordinance has been approved to help educate the residents. Mr. <br /> McQuillan stated he would. <br /> New Business <br /> Update on Silver Lake Road/Rice Creek Trail Accident <br /> Director Jacobson reported the State Patrol accident reconstruction report has been completed for <br /> the June accident where a bicyclist was struck by a car and injured. The end results of this report <br /> are: driver of car—no alcohol present,marijuana present however no physical indication of <br /> impairment on that day, estimated vehicle speed at 54 mph, text messages being sent and <br /> received in close proximity to accident time but don't know for sure and can't prove it, and very <br /> poor tire condition. <br />
