patterns of circulation, visual character, and sufficiency of drainage and utilities. <br />c. The extent to which the proposed uses will be compatible with present and planned <br />uses in the surrounding area. <br />d. That the design of the development justifies any exceptions to the standard <br />requirements of the Zoning Code. <br />e. The sufficiency of each phase of the planned development size, composition and <br />arrangement in order that its construction, marketing, and operation is feasible <br />without dependence upon any subsequent unit. <br />f. The burden or impact created by the planned development on parks, schools, streets, <br />and other public facilities and utilities. <br />g. The impact of the planned development on environmental quality and on the <br />reasonable enjoyment of surrounding property. <br />9. The Planning Commission and City Council find the proposed project meets the factors <br />e9tablished under Section 7-240. <br />Now THEREFORE BE IT RESOLVED, that based upon the above findings of fact the applications <br />for aiPreliminary PUD (PU2010-001), Final PUD (PU2010-002), Site Plan (LP2010-004) are <br />herebapproved, subject to the following conditions: <br />1. The project is constructed consistent with the plans submitted on 12-3-2010, drawn by <br />Finn Daniels Architects, Plowe Engineering Inc., and E.G. Rud and Sons Inc. all <br />attagljed to this report. <br />2. f The applicant enters into a PUD Declaration and Subdivision Agreement prior to <br />j obtaining a building permit. <br />3. Any ground mounted mechanical units shall be screened from adjacent properties, <br />stre t} and open spaces. <br />4. City Council adoption of ZA2010-005, amending Zoning Code Section 7-230(7). <br />5. The applicant is advised of all issues noted in the Interoffice Engineering, Public <br />Safely, and Parks memos attached to this report. <br />this 25h day of January, 2011.
