Mr. Bryce clarified that the state issues a license to sell used cars. Ms. Gundlach <br /> explained the process,the state issued license,and that the City can impose conditions. <br /> Vice Chair Schiferl asked for comments,there were none. <br /> Motion by Commissioner Alvey, seconded by Commissioner Nichols-Matkaiti to close the Public <br /> Hearing <br /> 5 Ayes,0 Nays,Motion Carried. <br /> The Public Hearing was closed at 7:43 p.m. <br /> Ms.Gundlach clarified the following conditions: <br /> 1. No more than 5 vehicles, in addition to employee or customer vehicles, are permitted on site during <br /> business hours. Further, the applicant may only store a maximum of 5 vehicles on site outside <br /> business hours. <br /> 2. Any vehicles located on the property, whether advertised for sale or not, shall be operable, in good <br /> repair, and be properly licensed. <br /> 3. Inoperable vehicles may not be kept on site. <br /> 4. All vehicles must be located in designated parking stalls at all times. <br /> 5. Hours of operation shall be limited to Monday through Friday, 9 am to 5 pm, Saturday by <br /> appointment only, and closed on Sunday. <br /> 6. Exterior advertisements including window signs are prohibit beyond a single wall sign compliant <br /> with Chapter 9. <br /> 7. Vehicles for sale requiring mechanical or body service must obtain that service off site. <br /> Commissioner Alvey suggested more specificity in condition 7: "Vehicles on site are ready for sale" <br /> Ms. Gundlach noted that was somewhat addressed in condition number 1 and 2. <br /> Commissioner Danger questioned if trade-ins are possible. Mr. Bryce confirmed they do accept trade- <br /> ins, and traded in vehicles become one of the five for sale. <br /> Vice Chair Schiferl requested clarification on the findings related to the business model. Commissioner <br /> Zisla suggested adding the following as a finding; "The business model reflects that which is stated in the <br /> written staff report dated March 9,2011." <br /> Motion by Commissioner Zisla, seconded by Commissioner Danger to approve the staff <br /> recommendation with the additions of a finding of fact(6F). <br /> "The business model reflects that which is stated in the written staff report dated March 9,2011." <br /> 5 Ayes,0 Nays,Motion Carried. <br /> 4 <br />
