According to Chapter <br /> 11.8 (see attachment) garbage and rubbish containers shall be placed in the rear of the premises, <br /> be out of view from the street in front of the house, or placed in the garage. The only exception is <br /> from 8:00pm the night before the day of collection until 8:00pm the day of collection. <br /> Current Enforcement Practice <br /> Currently city staff deals with enforcement on a complaint basis regarding the placement of <br /> garbage and rubbish containers. When a complaint is received staff will verify the situation and <br /> then send a letter informing the resident of the code requirement and asking them to comply <br /> within a week(letter attached). City staff will then re-inspect to see if the containers have been <br /> moved. If not, staff will send a second letter requesting compliance with seven days or the threat <br /> of a citation. In most instances, residents respond to the letters and comply with the code. Staff <br /> has also proactively written articles about the proper placement of garbage containers in the <br /> hopes of educating residents who may not know about the standards. <br /> Frequency of Complaints <br /> Staff will occasionally receive complaints from residents regarding this issue. The resident will <br /> usually call about more than property; in some cases providing a list of several addresses where <br /> containers are believed to be in violation. They usually ask if there is a code requiring New <br /> Brighton residents to store garbage and rubbish containers in the garage or out of site and then <br /> ask what staff will do about it. Staff knows there are 3 to 4 residents who are very active in <br /> making complaints regarding this issue each year. These residents have voiced concerns about <br /> the issue at neighborhood meetings and can be very vocal and demanding. Anecdotally staff <br /> believes a very high proportion of homes in New Brighton are not in compliance with this <br /> section of code at any given time. <br /> H:\Code Changes\Garbage cart memo doc(Edited).doc 1 <br />
