Approved <br /> Air Emissions <br /> At staff's request, the applicant provided an independent stack analysis performed on the same model <br /> machine the applicant wishes to install. The stack analysis lists a particulate level emitted, with <br /> particulates being the biggest concern. These levels are low enough to not pose any negative health risks, <br /> which is why the MPCA does not permit these facilities. Mr. Gantzer has explained to City staff that the <br /> level of particulates is important, but of greater importance is the temperature of the air coming out of the <br /> stack and the velocity of which it is propelled up into the atmosphere. Additional information was <br /> sought from the applicant to confirm the emissions were hot enough and buoyant enough to dissolve with <br /> enough air to not cause negative impacts. All the air emissions information suggests this business will <br /> not pose any negative health or environmental impacts. <br /> Odor <br /> All information provided by the applicant states there is no odor associated with the retort. <br /> City ordinance Section 6-390(8) states that odor cannot be readily detectable beyond the lot line. <br /> Staff has also proposed a condition that removes the word "readily" to state no odor is detectable at or <br /> beyond the property line. In an event an odor issue arises the applicant will have to undergo odor testing <br /> to solve the problem. <br /> If the problem cannot be solved the City has two options: <br /> • Revoke the Special Use Permit for noncompliance with conditions, and <br /> • Cite the owner for violation of Zoning Code Section 6-390(8), this would be a misdemeanor offense <br /> reviewed in criminal court. <br /> All information suggest odor will be not a problem, however there are workable options in place to <br /> handle an issue in the unlikely scenario one arises. <br /> Visual Impacts <br /> Concerns were raised regarding the visual impacts of this business from residences to the north. <br /> The applicant has proposed planting 6' evergreen trees along the northerly property boundary to provide <br /> additional screening, in addition to the other trees off the property within railroad right-of-way. <br /> City Planner Gundlach stated that with all the new information that has been provided since the last <br /> Planning Report, staff re-evaluated the special use standards of Section 8-130. Staff finds the proposal <br /> meets these standards. <br /> Staff recommends the City Council approve the request, subject to the conditions outlined in the <br /> Resolution. Those conditions include (abbreviated): <br /> • Additional screening along the northerly lot line & implementation of rain gardens per RCWD rules. <br /> • Pet cremation only& ancillary retail sales related to the cremation. <br /> • Applicant obtains all necessary permits. <br /> • City Building Official& Fire Marshal inspection prior to business. <br /> • One retort allowed—200 lbs max weight. <br /> • Ashes disposed of lawfully, no odor detectable at or beyond lot line. <br /> • Stack cannot exceed 1' above the peak of the roof, constructed on southern facing side of pitch, <br /> compliance with MPCA stack rules. <br /> • Pets brought into facility through door on south side of building. <br /> • Hours of operation restrictions. <br /> • No expansion allowed without review of an amendment to the SUP. <br /> 2 <br />
