RESOLUTION NO. <br />11-062 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />'HEAS, an application has been made by Donald Wyland & Carol Noren on behalf of Pets <br />Re mbered to permit operation of a pet cremation business at the existing building located at <br />15 2 1 AVE SE, and <br />JHE AS, the procedural history of the application is as follows: <br />1, 4p application for a Special Use Permit and Site Plan was received on April 1, 2011. <br />2. Idle Planning Commission, pursuant to published and mailed notices, held a public hearing <br />April 19, 2011 and all present were given a chance to freely speak at the hearing. <br />3. e Planning Commission tabled action on April 19th to allow gathering of additional <br />4. e applicant withdrew their request for a Site Plan on May 13, 2011. <br />5. 1 e Planning Commission, pursuant to published and mailed notices, continued the public <br />1.4aring on May 17, 2011 and all parties were given the chance to freely speak. <br />6. Ile Planning Commission recommended the City Council approve the Special Use Permit, <br />s biect to conditions. <br />City Council considered the request on May 24, 2011. <br />IHEI AS, the Planning Commission and City Council make the following Findings of Fact with <br />resp t to the Special Use Permit (SP2011-007): <br />1. e property is zoned 1-1, Light Industrial. <br />2. ie property is guided in the Comprehensive Plan for Light Industrial. <br />3. ie applicant has proposed to operate a pet cremation business, including the sale of <br />cillary pet cremation/memorial merchandise, out of the existing building located at 15 2nd <br />E SE. <br />4. oning Code Section 6-050(2) allows approval of any use through Special Use Permit within <br />t ic I-1, Light Industrial, so long as the use is neither residential nor deemed heavy. <br />5. The Planning Commission and City Council reviewed the proposal in accordance with the <br />]lowing Special Use Permit conditions of Zoning Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />I\Community Developmaw,5-24-201 I\SP2011-007 (Wand & Noren) - RESOLr1TION.doa <br />
