Tbe Planning Commission and City Council found all Special Use Permit criteria of Section <br />1-j130 to be met due to the following: <br />aj. The proposed location is in a primarily industrial area with no residential uses directly <br />adjacent. <br />l>Lj Adequate parking will be provided on site and traffic to the site will decrease. <br />The cremation services will be for pets only. <br />�. The site is used and immediately surrounded by other industrial uses. <br />ci The applicant has provided manufacturer specifications on the proposed retort which <br />states that emissions are below MPCA permitting guidelines and there are no odors <br />emitted into the air. <br />f, j The applicant will be making improvements to the building and site, which will have an <br />j overall positive impact to the area. <br />4. Numerous crematories are located in and near residential areas and do not pose any <br />negative impacts. <br />NOW ITHEREFORE BE IT RESOLVED, that based upon the above findings of fact the application <br />for Special Use Permit (SP201 I-007) is hereby approved, subject to the following conditions: <br />1. Twelve, six foot arborvitaes of a variety of the applicant's choosing shall be implemented <br />aI ng the northern property boundary, centered along the length of the building. The rain <br />rdens shall be installed per the RCWD rules. <br />2. lie Special Use Permit shall permit pet cremation only, which includes the ancillary retail <br />sile of cremation/memorial products for pets. <br />3. e applicant obtains all necessary air emissions and environmental permits and submits <br />se permits (if required) to the City in conjunction with required building, mechanical, <br />at d electrical permits. <br />4. The City Building Official and Fire Marshal inspect the facility following completed <br />i i stallation of the retort and in advance of opening for business. <br />5. y one cremation machine may be permitted within the building, with a maximum <br />fight capacity of 200 lbs. The applicant shall install the machine represented to the City <br />t i tough this review (B&L200) and cremate pets one at a time. <br />6. 1 J iclaimed ashes are managed in a lawful manner. <br />7. 1 odors shall be detectable at or beyond the property line. <br />8. e proposed retort shall quality as a Class IV waste combustor per the MPCA guidelines. <br />9. e necessary stack shall not exceed a height of 1' above the peak of the existing roof. <br />e necessary stack shall comply with MPCA rules concerning ambient air pollution <br />ncentrations and the stack shall be located on the southern side of the pitched roof. <br />10. Fatrons of the business shall carry pets into the building from the southern building access <br />or so as to limit view of dead pets from the north. <br />11. y expansion shall require review and approval of an amendment to this Special Use <br />II\Community Development\5-24-2011\SP2011-007(Wyland&Normi)-RESOLUT]ON _doc 2 <br />
