110 ity of <br /> -BRIGH <br /> fUN <br /> the city that works for you <br /> Council Worksession <br /> September 6, 2011 <br /> 5:30 pm <br /> Present: Mayor Jacobsen <br /> Councilmember Samuelson <br /> Councilmember Phillips <br /> Councilmember Bauman <br /> Councilmember Burg <br /> Absent: None <br /> Staff in attendance: <br /> Dean Lotter, City Manager <br /> Dan Maiers, Finance Director <br /> Grant Fernelius, Director of Community Development <br /> Grant Wyffels, Director of Public Works <br /> Bob Jacobson, Director of Public Safety <br /> Sandy Breuer, Director of Parks and Recreation <br /> Schawn Johnson,Assistant to the City Manager <br /> Janice Gundlach, City Planner <br /> Meeting was called to order at 5:30 PM. <br /> Comprehensive Plan and Zoning Amendment Fee Waiver Request: <br /> Lori Schoonover is requesting Council to waive the Rezoning and Comprehensive Plan <br /> Amendment fees of$1,000 each in order to rezone and re-guide the property at 230 1st <br /> Street SE from Light Industrial to R-1 Single Family Residential. <br /> Janice Gundlach stated that the City of New Brighton has a Non-conforming Use <br /> Ordinance. This ordinance allows residents to maintain and expand upon a non- <br /> conforming use. For example if a property owners requests a side yard set back of 4 feet <br /> and the City Code requires a 5 feet set back and the resident wants to do an addition, the <br /> property owner would have to complete the application process, appear before the <br /> Planning Commission and have a survey of their property completed. <br /> Council Member Phillips stated that he is not compelled to waive the fees. This may set <br /> an expectation for Council to offer approvals to waive fees. He stated that it's <br /> 1 <br />
