appropriately guided and zoned as light industrial therefore by waiving the fees Council <br /> would be amending the Comprehensive Plan not just the zoning of the property. <br /> Mayor Jacobsen asked Janice Gundlach if it were appropriate to spot zone according to <br /> State statue. City Planner Gundlach stated that it would be not be appropriate to only re- <br /> guide and rezone one property. Ms. Gundlach has advised Ms. Schoonover that if all <br /> four properties came in jointly to request the rezoning of these properties it would be one <br /> fee for the application to rezone and re-guide these properties. <br /> Mayor Jacobsen questioned if the residents affected by this were resistant to request for <br /> change due to the fees that were the involved with this process. City Planner Gundlach <br /> stated that she has only talked to Ms. Schoonover and to the owner at 280 1st Street SE. <br /> She has not had any communication with the other two residents. <br /> Council Member Burg stated that she does not agree with waiving the fees, but perhaps <br /> there is an alternative. Councilmember Burg stated that the City of Brighton has a fee <br /> schedule and that they should follow it. <br /> Council Member Bauman stated that with the housing market being in tough shape <br /> already, the rezoning of this property would help sell it. Council Member Bauman <br /> commented that if all four residents jointly came to the City Council they would have a <br /> better case for re-guiding and re-zoning. Council Member Bauman would be ok if they <br /> split the fee to re-guide and re-zone the properties so that the zoning would help the <br /> residents sell their homes. <br /> Ms. Schoonover stated that she has spoken with the resident at 3793 New Brighton Road, <br /> the property owner wants to keep it light industrial. The property owners at 330 1st Street <br /> SE and 280 1st Street SE would like to be zoned residential. <br /> Mayor Jacobsen asked that the Council vote on whether or not to waive the Rezoning and <br /> Comprehensive Plan Amendment fees of$1,000 each in order to rezone and re-guide the <br /> property at 230 1st Street SE from Light Industrial to R-1 Single Family Residential. <br /> Council Member Phillips motioned to not waive the fees. The City Council voted 4 to 1 <br /> in favor of not waiving the fees. <br /> 2012 Budget: <br /> City Manager Dean Lotter provided the City Council with an overview of the August 23rd <br /> budget worksession meeting. He updated the Council and Mayor on how legislative <br /> changes approved this summer have affected the levy, tax base, and therefore the tax rate <br /> for the City. Staff provided the City Council with four different scenarios to demonstrate <br /> the variables of the tax levy decision and how that may impact residents of New Brighton <br /> in 2012. City Manager Lotter stated that understanding the proposed budget and its <br /> implications on taxpayers will assist the Council in providing further guidance on the <br /> remaining issues that need Council direction. <br /> 2 <br />
