WHEREAS, the City of New Brighton ("City") is a municipal corporation and subdivision <br />of ~e State of Minnesota organized and operating under Minnesota law, ~d is authorized by Minn. <br />statl ~ 412.211, 9 465.01 and Ch. 469 to acquire real estate by exercising the power of eminent <br />dorpain under and pursuant to Minn. Stat., Ch. 117; and <br /> <br />" <br />i <br /> <br />I , WHEREAS, the City Council of the City of New Brighton is the official governing body of <br />the; tity of New Brighton~ and <br /> <br />" <br />Ii <br />I, WHEREAS, pursuant to Minn. stat. Ch. 469, the City has the authority to establish <br />dey~lopment districts, development projects and tax increment financing districts; and <br /> <br />WHEREAS, the City Council established Development District No.1 (the "Development <br />Di$(rict") on December 22, 1981. and thereafter enlarged it; and <br /> <br />WHEREAS, the real estate described in Exhibit A attached hereto and incorporated herein <br />("S*bject Property") is located within the Development District and is among the parcels which <br />m"y be acquired; and <br /> <br />WHEREAS, the City Council has adopted its Old Highway 8 Corridor Study which is the <br />Ci~'s Development Program for Development District No.1 and provides that the future use of the <br />Supject Property will be for housing; and I <br />v <br /> <br />I . WHEREAS, acquisition of the Subject Property by the City is essential in order to eliminate <br />th~ Subject Property as a barrier to redevelopment of the Northwest Quadrant; and <br /> <br />WHEREAS, the City has performed all actions required by law to be performed prior to the <br />c~tion of the Development District, and adoption of the Development Program and TIP Plan; and <br /> <br />WHEREAS, the City Council finds that the Subject Property includes non-conforming uses <br />wiPch have been expanded without required City Council approval~ and <br /> <br />WHEREAS, the City Council fmds pursuant to public records and environmental reports in <br />tMiCity's possession, that the Subject Property is likely to contain a hazardous substance, pollutant <br />or qontaminant, or that a release of a hazardous substance, pollutant or contaminant is likely to have <br />ocCPrred on the Subject Property; and <br /> <br />R..JL.1S643Ivl <br />NEJj6-163 <br />
