WHEREAS, the presence of a release of a hazardous substance, pollutant or contamin3;I1t on <br />the Sixbject Property is likely to be a significant barrier to early redevelopment of the Subject <br />Property without public intervention; and <br /> <br />WHEREAS, the Subject Property contains more than 30 acres of land, most of which is not <br />impI'(jved with pennanent structures, much of which is used for outside storage and all of which is <br />bligh~d and underutilized~ and <br /> <br />WHEREAS, the City Council finds that redevelopment of the Subject Property pursuant to <br />the l'Fovisions of the Development Program is necessary, convenient, desirable, for a public <br />purppse, in the best interests of the citizens of the City and would promote the general health, <br />welf~ and safety of the community; and <br />Ii <br />'i WHEREAS, the Development Program contemplates that substantial portions of the Subject <br />Pro~rty should be redeveloped for housing purposes; and <br /> <br />WHEREAS, the City Council finds that the provision of additional housing units and <br />hou$.pg types. on the Subject Property is in the public interest and in furtherance of the City's goals <br />and ~jectives for the Development District~ and <br /> <br />: WHEREAS, entry on the Subject Property is rationally related to the health, safety or <br />welf~e concerns of the City in connection with the possible eminent domain proceedings; and <br /> <br />WHEREAS, the City Council finds that it is reasonable, necessary, proper, convenient, for a <br />pubij.~ purpose, and in the interest of the public health, safety, convenience, and general welfare of <br />the citizens of the City that title to and possession of the real estate hereinafter described be acquired <br />in fuIitherance of the Project. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of New <br />Brighton, Minnesota that: <br /> <br />1. The City Council hereby finds that it is necessary that the Subject Property <br />be acquired in fee simple absolute for the stated public pwposes through the exercise of the <br />power of eminent domain. <br /> <br />2. The City Attorney is hereby authorized and directed to take all steps <br />necessary to acquire said real estate by use of eminent domain proceedings. <br /> <br />3. Pursuant to Minn. Stat ~1l7.041, Subd. 2, the City deems it necessary to <br />enter the Subject Property for purposes of investigation, monitoring, testing. surveying, <br />boring, drilling or other similar activities necessary or appropriate to identify the existence <br />and extent of a release or threat of release of a hazardous substance, pollutant or <br />contaminant on said real estate. <br /> <br />RJL-I~3Ivl <br />NEI3fi..l163 <br /> <br />2 <br />
