NEW Report Number 12-083 <br /> BRIGTITON Agenda Section VI-8 <br /> the city that works for you Council Meeting Date April 10, 2012 <br /> REQUEST FOR COUNCIL CONSIDERATION <br /> ITEM DESCRIPTION: FEASIBILITY STUDY FOR PROJECT 12-4, BICENTENNIAL POND <br /> TAXATION DISTRICT <br /> DEPARTMENT HEAD'S APPROVAL: <br /> CITY MANAGER'S APPROVAL: _ <br /> No comments to supplement this report Comments attached <br /> Recommendation: To receive the FE S ILITY STUDY FOR A POND MANAGEMENT <br /> PROJECT ON BICENTENNIAL POND, and to order public hearings to consider the proposed <br /> pond management project and the adoption of a storm sewer improvement taxing district to pay <br /> for the project. The public hearing is to be held at 6:30 pm on Tuesday, the 8th day of May, <br /> 2012. <br /> Legislative History: On April 9, 2002, the City Council adopted an ordinance establishing a <br /> storm sewer improvement taxing district including 14 properties located on or near the pond. On <br /> December 8, 2009, a resolution was made by City Council to consider revising the taxing district <br /> boundaries for the upcoming 2011 assessment. On July 13, 2010, at a Council Work Session, <br /> staff provided information to the Council regarding history; how the district boundaries were <br /> established; project funding; and, the recent reluctance of some of the neighbors to continue on <br /> with the district. On October 12, 2010, the taxation district was dissolved. A petition was <br /> received on September 2, 2011 for creation of a new taxation district and the City Council <br /> accepted the petition on November 7, 2011. On March 29, 2012, staff held a neighborhood <br /> meeting with affected properties to finalize the feasibility study. <br /> Financial Impact: This project, if approved, would be funded 75% from the taxation district <br /> and 25% from Stormwater Improvement Fund 421. <br /> Explanation: The purpose of this item is to present the attached FEASIBILITY STUDY FOR <br /> POND MAINTNENANCE PROJECT ON BICENTENNIAL POND. Staff has met with <br /> residents of Bicentennial pond and they have requested that the City hire a pond maintenance <br /> company to treat Bicentennial Pond for weeds and to create a storm sewer improvement taxing <br /> district of the 9 lots abutting the pond to pay for the cost. This would be similar to the storm <br /> sewer taxing district that was set up for Lake Diane, and previously with 14 lots surrounding <br /> Bicentennial Pond in 2002. The pond maintenance project and storm sewer taxing district is <br /> proposed to be established for an initial 5 year period beginning in year 2012 and ending in 2016. <br /> Costs and Funding: The attached feasibility study contains cost estimates and recommended <br /> fundin <br /> Craig G.
