Agenda Section: V I I I-8 <br /> CITY OF NEW BRIGHTON <br /> Report Number: 9 8-0 9 8 <br /> REQUEST FOR COUNCIL CONSIDERATION <br /> 41111 Report Date:_4/21/98 <br /> ITEM DESCRIPTION: SILVER OAK TENNIS <br /> DEPARTMENT HEAD'S APPROVAL: <br /> MANAGER'S REVIEW/RECOMMENDATIONN:J <br /> No comments to supplement this report I nib SI Comments below/attached <br /> EXPLANATION/SUMMARY (attach supplemental sheets as necessary): <br /> In 1977 the City of New Brighton entered into a joint powers agreement with St. Anthony District #282. The <br /> purpose of the agreement was to cooperatively develop the Silver Oak School grounds so that they would better <br /> serve the school and the neighborhood as a park. Improvements included additional playground equipment, <br /> ballfield improvements, a picnic shelter and two tennis courts. The improvements were City financed with the <br /> exception of the tennis courts that were funded by a State of Minnesota Grant. <br /> In 1980 the school district declared the property to be surplus and sold it to Ditzler and Cadwallader who converted <br /> the school building into condominiums. The land on which the tennis courts were located was also sold and was <br /> Tanned to be a townhouse development. The City obtained the remaining five acres for park purposes. The City <br /> entered into an agreement with the developer granting the City license to allow public use of the tennis courts until <br /> the townhouse development occurred. The developer further agreed to replace the tennis courts at his expense at <br /> the time of relocation. State law requires replacement of park facilities built with grant funds although no strict <br /> timeline is required. <br /> In approximately 1985 Mr Cadwallader, at the City's request, graded an area for tennis courts at the base of the <br /> hill near Oakwood Drive. This area had been identified in 1980 as the preferred location for the tennis courts. <br /> Given the topography of the site there is only room for one court at this location. This area has been used for the <br /> past several years as an ice skating area in the winter and for little kids soccer in the summer. The area does work <br /> well for skating but is inadequate even for little kids soccer. <br /> The original agreement with Ditzler and Cadwallader called for the developer to replace the courts at their <br /> expense. An estimate of the replacement cost was made in 1995 when the townhouse project was being constructed <br /> and that cost was $40,000.00. Mr. Cadwallader was given $5,000.00 credit for the grading and soil compaction <br /> work done in 1985 and the City was presented a check for $35,000.00. Staff and the Parks, Recreation and <br /> Environmental Commission recommended installation of one court at Silver Oak and that an additional court be <br /> built at a later date, probably at Innsbruck Park. <br /> CONTINUED <br /> Recommendation <br /> To direct staff to prepare plans and specifications for one tennis court at Silver Oak Park to be located near <br /> Øak\ ood <br /> Drive. <br /> Maurice H.
