4 . That the proposed park be 4 . 93 acres in size; <br /> 5. That there be at least 300 feet of access to the park <br /> off of Oakwood Drive , preferably that there be no furthe <br /> residential construction along Oakwood to extend further <br /> 4 to the north than the northeast boundary of the existing <br /> building; <br /> 6. That the tennis courts at the expense of the applicant <br /> be relocated in the northeast corner with acceptable <br /> access and constructed to City specifications ; <br /> 7 . That any park equipment to be relocated as a result of <br /> the proposed development be approved by the Park Board <br /> and that financial responsibility be determined; <br /> 8; That the grades north of the proposed condominium site b: <br /> altered to alleviate liability concerns through land- <br /> scaping and that any landscaping installed by the <br /> applicant be approved by the Park Board; <br /> 9 . That the townhouse units constructed on the site meet <br /> the parking requirements in the zoning code; <br /> 10. That the maximum number of condominium units allowed in <br /> the existing school structure is 23 units ; <br /> 11. That the maximum number of additional units to be <br /> constructed shall not exceed 12 units and that the units <br /> would be west of the existing building or in the south- <br /> west corner of the site. <br /> 12. That the required garages are constructed for the condo- <br /> minium units which are of the same architectural design <br /> and materials as the existing structure and are complete y <br /> i! enclosed; <br /> 1� 13. That the proposed development will not require the <br /> 111 <br /> installation of any public streets; <br /> i{ 14 . That separate convenants, Home Owners Association, and <br /> deed restrictions are required for the condominium unit <br /> and the townhouse development and that the documents be <br /> I reviewed and approved by the City Attorney; <br /> 15. That the final plat and plans for PRD #30 show each of <br /> the residential units having its own legal description <br /> so as to provide for individual ownership of the units ; . <br /> 16 . That the final plan provide a landscape plan which <br /> includes the screening through landscaping of the <br /> existing parking lot adjacent to Oakwood Drive; <br /> 17. That the necessary agreement is provided for the joint <br /> use of the private drive off of Silver Lane. The <br /> agreement should allow use by the condominium residents, <br /> townhouse residents and City maintenance vehicles <br /> servicing the park; <br /> • 18 . That the townhouse units are -setback from the property <br /> line at least 25 feet; <br /> 19. That the applicant dedicate a watermain easement on the <br /> final plat to be subject to approval by the City Enginee , ; <br /> 20 .
