RESOLUTION NO 2302 <br /> r, .1 <br /> i. <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> 411 , <br /> `` • CITY OF NEW BRIGHTON <br /> RESOLUTION PMAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> : FOR A PRELIMINARY PLANNED RESIDENTIAL DEVELOPMENT , PRD #30 <br /> AND A PRELIMINARY PLAT , PL-121 <br /> i WHEREAS , The procedural history .of the application is <br /> '.. as follows : <br /> it 1 . That an application for a preliminary Planned <br /> Residential Development , PRO #30 and a preliminary <br /> plat , PL-121 was filed with the City of New <br /> lo <br /> i Brighton on November 13 , 1979 , <br /> {i 2 . That such application was reviewed by the New <br /> Brighton Planning Commission Board of Review <br /> on November 20 , 1979 , December 17 , 1979 and <br /> 1 January 15 , 198U . In addition , the Park Board 1. <br /> reviewed the application on December 6 , 1979 <br /> and February 6 , 1980 . <br /> 3 . That the City Council , pursuant to published <br /> and mailed notices , held a public hearing on <br /> February 12 , 1980 and February 27 , 1980 . all <br /> person ' s present at the hearings were given an <br /> opportunity to be heard . <br /> 4 . The written comments and analysis of the City <br /> 411 staff, the Planning Commission minutes and <br /> recommendations , the Park Board minutes and <br /> I recommendations were considered . <br /> I <br /> NOW THEREFORE BE IT' RESOLVED , <br /> That <br /> Council makes the following Findings of Fact Nin r respect ntoity <br /> PRD #30 and PL- 121 : <br /> h <br /> 1 . That the proposed development is consistent with <br /> the proposed Comprehensive Plan ; <br /> ; 2 . That the proposed development would not be <br /> i detrimental to public health , safety , morals <br /> and general welfare of the surroundingarea ; <br /> and <br /> ;' 3 . That the proposal is consistent with the stated <br /> i; Rurposes of the PRO ordinance as it makes the a <br /> most efficient use of the land and open space . <br /> !; BE IT FURTHER RESOLVED , That the application for the <br /> Ili preliminary PRD #30 and <br /> preliminary plat PL-121 is and hereby <br /> approved subject to the following conditions : <br /> I <br /> II 1 . That all grading , drainage and utilities be <br /> 0o <br /> subject to approval of the City Engineer and <br /> {i Rice Creek Watershed District ; <br /> III Pi 2 , That all fire and emergency lanes , sprinkling <br /> ji connections , and emergency access shall be <br /> 11 subject to the approval of the fire department ; <br /> 3 , That the applicant dedicate the park property <br /> to the City in the form of a deed . That in <br /> lieu of a deed transfer of the property that <br /> appropriate legal agreements be concluded <br /> between the City and applicant regarding <br /> use of `.the park facilities and property ; <br />
