STATE OF MINNESOTA COUNTY OF RAMSEY 411 , `` • CITY OF NEW BRIGHTON RESOLUTION PMAKING FINDINGS OF FACT AND APPROVING APPLICATION : FOR A PRELIMINARY PLANNED RESIDENTIAL DEVELOPMENT , PRD #30 AND A PRELIMINARY PLAT , PL-121 i WHEREAS , The procedural history .of the application is '.. as follows : it 1 . That an application for a preliminary Planned Residential Development , PRO #30 and a preliminary plat , PL-121 was filed with the City of New lo i Brighton on November 13 , 1979 , {i 2 . That such application was reviewed by the New Brighton Planning Commission Board of Review on November 20 , 1979 , December 17 , 1979 and 1 January 15 , 198U . In addition , the Park Board 1. reviewed the application on December 6 , 1979 and February 6 , 1980 . 3 . That the City Council , pursuant to published and mailed notices , held a public hearing on February 12 , 1980 and February 27 , 1980 . all person ' s present at the hearings were given an opportunity to be heard . 4 . The written comments and analysis of the City 411 staff, the Planning Commission minutes and recommendations , the Park Board minutes and I recommendations were considered . I NOW THEREFORE BE IT' RESOLVED , That Council makes the following Findings of Fact Nin r respect ntoity PRD #30 and PL- 121 : h 1 . That the proposed development is consistent with the proposed Comprehensive Plan ; ; 2 . That the proposed development would not be i detrimental to public health , safety , morals and general welfare of the surroundingarea ; and ;' 3 . That the proposal is consistent with the stated i; Rurposes of the PRO ordinance as it makes the a most efficient use of the land and open space . !; BE IT FURTHER RESOLVED , That the application for the Ili preliminary PRD #30 and preliminary plat PL-121 is and hereby approved subject to the following conditions : I II 1 . That all grading , drainage and utilities be 0o subject to approval of the City Engineer and {i Rice Creek Watershed District ; III Pi 2 , That all fire and emergency lanes , sprinkling ji connections , and emergency access shall be 11 subject to the approval of the fire department ; 3 , That the applicant dedicate the park property to the City in the form of a deed . That in lieu of a deed transfer of the property that appropriate legal agreements be concluded between the City and applicant regarding use of `.the park facilities and property ;
