RESOLUTION No. • CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SUBDIVISION OF CERTAIN PROPERTY WITHIN THE CITY OF NEW BRIGHTON(GENERALLY THE NORTHEAST CORNER OF 5TH AVENUE AND 1ST STREET NW). WHEREAS,the City of New Brighton has been requested to subdivide certain property in the City of New Brighton described as follows: That part of the Southeast Quarter of the Southeast Quarter of Section 29, Township 30, Range 23, Ramsey County Minnesota lying east of 5th Avenue Northwest, lying north of vacated 1st Street Northwest, lying west of the westerly right-of-way of Interstate Highway 35W, except that part platted as Brighton Corporate Park. AND That part of vacated 1st Street lying west of the westerly right-of-way of Interstate Highway 35W and easterly of 5th Avenue Northwest. WHEREAS, State Statutes require that if such property is located in municipalities that have adopted a platting ordinance, approval of the municipality must be obtained before such subdivisions IP can be filed; and WHEREAS, Section 26-24 of the New Brighton City Code provides for subdivision of property without platting if certain criteria can be met. Now,THEREFORE BE IT RESOLVED,the City Council of the City of New Brighton recommends approval of the subdivision of the above-described property into parcels described as follows: Lots 1 and 2, Block 1,Brighton Corporate Park II, according to the recorded plat thereof, and situate in Ramsey County, Minnesota. BE IT FURTHER RESOLVED,the City Council of the City of New Brighton recommends approval of PL-243, subject to the following conditions: 1. Approval and continuing compliance with PUD-6.
