HEAD'S APPROVAL: <br /> MANAGER'S REVIEW/RECOMMENDATION: <br /> No comments to supplement this report Comments attached <br /> EXPLANATION/SUMMARY (attach supplemental sheets as necessary) <br /> The purpose of this item is to obtain Council approval of: 1)a purchase agreement with Hypro Corporation for an <br /> easement for the construction of the storm water storage pond, and 2)plans and specifications for the construction of the <br /> storm water storage pond and authorization to advertise for bids. This project is referred to as Brighton Corporate Park III, <br /> Contract#1 and has been assigned the project number 96-11. <br /> The storm water pond will be located on the northeast corner of the Hypro Corporation property on 5th Avenue NW. The <br /> work included in this contract#1 is the construction of the pond,the installation of the 36 inch storm sewer inlet, and the <br /> 12-inch storm sewer outlet. The location of the pond and storm sewers are shown on the attached map. The storm water <br /> storage pond will eliminate an existing flooding problem at the 3rd Avenue NW and County Road E2 intersection. The <br /> pond is also needed to handle storm water drainage from the phase I Donatelle building to be built on the north end of the <br /> er MacGillis and Gibbs site. The pond will be excavated below the outlet storm sewer to permanently hold water in <br /> cordance Rice Creek Watershed District standards. The pond perimeter will be gently sloped for safety and <br /> maintenance. The pond will not be fenced. <br /> A copy of the purchase agreement with Hypro Corporation is attached. The purchase price and terms of the agreement are <br /> based on the purchase of a 1.6 acre easement area for the pond for $131,770, less 24% of the construction and engineering <br /> cost of the pond and outlet storm sewer, for a total payment of not less than$106,000. The 24%of the pond construction <br /> and engineering cost represents that portion of the storage pond needed to handle storm water runoff from the Hypro <br /> property when it is fully developed. $106,000 would be paid to Hypro at the time of closing. The $25,770 difference <br /> between the easement cost and the initial payment will be held in escrow until after bids are received for the project. If the <br /> bid comes in such that the 24% Hypro share is less that$25,770,the difference would be owed to Hypro at that time. <br /> Cont. Page 2 <br /> RECOMMENDATION <br /> 1.
